【摘要】:商業(yè)外觀起源于美國(guó),其并沒(méi)有一個(gè)準(zhǔn)確的定義。在美國(guó)等西方國(guó)家,商業(yè)外觀早就已經(jīng)納入法律中進(jìn)行保護(hù)。在我國(guó)國(guó)內(nèi)對(duì)商業(yè)外觀法律保護(hù)有所需求的情況下,現(xiàn)行知識(shí)產(chǎn)權(quán)以及反不正當(dāng)競(jìng)爭(zhēng)法對(duì)商業(yè)外觀保護(hù)的規(guī)定已經(jīng)不能夠給我國(guó)商業(yè)外觀以有力的保護(hù)。且眾多法律規(guī)定對(duì)商業(yè)外觀的交叉保護(hù)和商業(yè)外觀尚未明確的性質(zhì)使得我國(guó)對(duì)商業(yè)外觀的保護(hù)始終處于一個(gè)比較有限的水平。我國(guó)企業(yè)在對(duì)外進(jìn)行相關(guān)貿(mào)易活動(dòng)中不能得到有關(guān)商業(yè)外觀方面法律的完整保護(hù),以致于企業(yè)價(jià)值最大化目標(biāo)不能實(shí)現(xiàn),最終也有損我國(guó)國(guó)際競(jìng)爭(zhēng)力,不利于我國(guó)引進(jìn)先進(jìn)技術(shù)和流動(dòng)性更強(qiáng)的資本。與此同時(shí),商品和服務(wù)外觀保護(hù)制度的不完善,也不利于中國(guó)國(guó)內(nèi)市場(chǎng)的發(fā)展。所以,我們應(yīng)該加大對(duì)商業(yè)外觀研究的力度,只有這樣才能使我國(guó)企業(yè)對(duì)外的發(fā)展和交流中,不再處于弱勢(shì)地位,使商業(yè)外觀制度能夠維持我國(guó)企業(yè)在國(guó)際上的競(jìng)爭(zhēng)力并且保護(hù)國(guó)內(nèi)良好的競(jìng)爭(zhēng)秩序。本文系統(tǒng)闡釋了對(duì)商業(yè)外觀進(jìn)行研究的意義和背景,總結(jié)了國(guó)內(nèi)外學(xué)者觀點(diǎn)。并在此基礎(chǔ)上探究了商業(yè)外觀基本理論,分析了商業(yè)外觀的含義及對(duì)其進(jìn)行法律保護(hù)的可能性,從多角度分析了我國(guó)商業(yè)外觀保護(hù)的必要性。進(jìn)而提出了我國(guó)商業(yè)外觀保護(hù)存在的法律問(wèn)題,研究并借鑒了美國(guó)在商業(yè)外觀保護(hù)方面的先進(jìn)經(jīng)驗(yàn)。最終提出了在我國(guó)對(duì)商業(yè)外觀進(jìn)行保護(hù)的建議。
[Abstract]:Commercial appearance originated in the United States, and it does not have an accurate definition. In Western countries, such as the United States, commercial appearance has long been protected by law. Under the circumstance of our country's domestic demand for the legal protection of the commercial appearance, the current intellectual property rights and the provisions of the anti-unfair competition law on the protection of the commercial appearance can no longer give our country a strong protection of the commercial appearance. And many laws and regulations on the cross-protection of the commercial appearance and the nature of the commercial appearance has not been clear that the protection of the commercial appearance in China has always been in a relatively limited level. Chinese enterprises can not get the complete protection of the law on the commercial appearance in their foreign trade activities, so that the goal of maximizing the value of enterprises can not be realized, which will ultimately damage the international competitiveness of our country. It is unfavorable for China to introduce advanced technology and more liquid capital. At the same time, the imperfect system of protecting the appearance of goods and services is not conducive to the development of China's domestic market. Therefore, we should strengthen the research on the commercial appearance. Only in this way, can our enterprises no longer be in a weak position in the development and exchange of foreign countries. So that the commercial appearance system can maintain the international competitiveness of Chinese enterprises and protect the domestic good competition order. This paper systematically explains the significance and background of the research on commercial appearance and summarizes the views of domestic and foreign scholars. On this basis, this paper probes into the basic theory of commercial appearance, analyzes the meaning of commercial appearance and the possibility of its legal protection, and analyzes the necessity of commercial appearance protection in China from various angles. Then it puts forward the legal problems existing in the protection of commercial appearance in our country, and studies and draws lessons from the advanced experience of the United States in the protection of commercial appearance. Finally, the suggestion of protecting the commercial appearance in our country is put forward.
