【摘要】：專利制度在我國實(shí)施三十年以來,我國在中藥專利保護(hù)上取得顯著成果,傳統(tǒng)中藥復(fù)方專利保護(hù)是傳統(tǒng)中藥專利保護(hù)其中的一項(xiàng)重點(diǎn)內(nèi)容,由于自身特性,如其藥用組分復(fù)雜,難以鑒定,在其專利保護(hù)上存在認(rèn)識(shí)與操作上的諸多難題,傳統(tǒng)中藥復(fù)方的專利保護(hù)體系還存在很大的缺陷。本文將中藥學(xué)和法學(xué)相結(jié)合,討論傳統(tǒng)中藥復(fù)方保護(hù)范圍,分析其專利保護(hù)的申請現(xiàn)狀,指出存在的問題和誤區(qū),對(duì)中藥復(fù)方的專利保護(hù)提出一些建議,以求對(duì)我國中藥復(fù)方專利保護(hù)有所裨益。 第一部分,研究傳統(tǒng)中藥復(fù)方專利保護(hù)的技術(shù)主題和申請現(xiàn)狀。通過國家知識(shí)產(chǎn)權(quán)局專利網(wǎng)站,檢索近十年的傳統(tǒng)中藥復(fù)方專利申請數(shù)據(jù),進(jìn)行數(shù)據(jù)分析研究,找出造成目前現(xiàn)狀的原因,包括技術(shù)、司法認(rèn)定、政策原因,之后再對(duì)這些原因進(jìn)行逐個(gè)的列舉分析。 第二部分,闡述傳統(tǒng)中藥復(fù)方專利的三性審查問題,即研究與探討專利授權(quán)的三性條件,正確解讀中藥復(fù)方專利的“三性”標(biāo)準(zhǔn),制定適合與我國國情及中藥特性的三性審查標(biāo)準(zhǔn),尋找出對(duì)傳統(tǒng)中藥復(fù)方進(jìn)行專利保護(hù)的最佳切入點(diǎn),進(jìn)而對(duì)傳統(tǒng)中藥復(fù)方實(shí)施有效保護(hù)。本文從傳統(tǒng)中藥復(fù)方發(fā)明專利申請的創(chuàng)造性和傳統(tǒng)中藥復(fù)方方法專利申請的創(chuàng)造性兩個(gè)方面進(jìn)行了具體的說明。 第三部分,先明確我國傳統(tǒng)中藥復(fù)方專利侵權(quán)認(rèn)定的現(xiàn)狀,然后探討傳統(tǒng)中藥復(fù)方專利侵權(quán)的認(rèn)定方法；明確了它的重要性后列舉出復(fù)方專利侵權(quán)認(rèn)定的原則,并依據(jù)原則針對(duì)傳統(tǒng)中藥復(fù)發(fā)的具體情況進(jìn)行分析。本文采取一般原則與特殊原則相結(jié)合的方式對(duì)復(fù)方專利各種情況進(jìn)行了必要的研究說明。同時(shí),對(duì)復(fù)方專利侵權(quán)的另一些重點(diǎn)原則,多種抗辯事由進(jìn)行了簡單的闡述。最終結(jié)合傳統(tǒng)中藥復(fù)方自身特性確立傳統(tǒng)中藥復(fù)方專利侵權(quán)認(rèn)定適宜的標(biāo)準(zhǔn)：對(duì)復(fù)方專利法中的一些條款的調(diào)整起到積極的作用。 第四、五部分,討論我國傳統(tǒng)中藥復(fù)方專利保護(hù)政策的制定措施,對(duì)外國的先進(jìn)經(jīng)驗(yàn)進(jìn)行分析,從中總結(jié)出對(duì)我國復(fù)方專利保護(hù)有意義的啟示,加強(qiáng)提高傳統(tǒng)中藥復(fù)方專利保護(hù)意識(shí),確立符合中藥復(fù)方專利特點(diǎn)的侵權(quán)認(rèn)定標(biāo)準(zhǔn),應(yīng)用較低的審核標(biāo)準(zhǔn),制定完善的中藥專利保護(hù)法律制度。 結(jié)論部分,從以上的分析研究進(jìn)行歸納總結(jié),提出當(dāng)前我國傳統(tǒng)中醫(yī)復(fù)方領(lǐng)域發(fā)明的創(chuàng)新程度不高,進(jìn)行復(fù)方專利三性審查時(shí)應(yīng)當(dāng)適當(dāng)?shù)慕档蜆?biāo)準(zhǔn),并盡快確定符合中藥復(fù)方特性的專利侵權(quán)標(biāo)準(zhǔn),應(yīng)意識(shí)到復(fù)方保護(hù)是一項(xiàng)系統(tǒng)性的大工程,對(duì)它的保護(hù)需要依賴綜合性的方式,形成傳統(tǒng)中藥復(fù)方專利保護(hù)網(wǎng)。我國傳統(tǒng)中藥復(fù)方專利保護(hù)必須從中藥復(fù)方自身的特性出發(fā),在適當(dāng)借鑒國外專利保護(hù)的基礎(chǔ)上,掏建有中國特色的傳統(tǒng)中藥復(fù)方專利保護(hù)的體系,從而更好的對(duì)復(fù)方專利權(quán)利人的權(quán)利進(jìn)行保護(hù)。
[Abstract]:Since the implementation of the patent system in China for 30 years, China has made remarkable achievements in the patent protection of traditional Chinese medicine. The patent protection of traditional Chinese medicine compound prescription is one of the key contents of the patent protection of traditional Chinese medicine, because of its own characteristics, such as the complexity of its medicinal components. It is difficult to identify, there are many problems in the knowledge and operation of patent protection, and the patent protection system of traditional Chinese medicine compound has great defects. By combining traditional Chinese medicine with law, this paper discusses the scope of traditional Chinese medicine compound protection, analyzes the present situation of its patent protection, points out the existing problems and misunderstandings, and puts forward some suggestions for the patent protection of traditional Chinese medicine compound. In order to our country traditional Chinese medicine compound patent protection has the benefit. The first part studies the technical theme and application status of patent protection of traditional Chinese medicine compound. Through the patent website of the State intellectual property Office, we searched the data of patent applications for traditional Chinese medicine compound for nearly 10 years, conducted data analysis and research, and found out the causes of the current situation, including technology, judicial determination, and policy reasons. Then the reasons are listed and analyzed one by one. In the second part, the author expounds the three aspects of the patent examination of the traditional Chinese medicine compound patent, that is, to study and discuss the three nature conditions of patent authorization, and to correctly interpret the "three properties" standard of the traditional Chinese medicine compound patent. In order to find out the best entry point for patent protection of traditional Chinese medicine compound, it is necessary to establish three standards of examination suitable for China's national conditions and characteristics of traditional Chinese medicine, so as to effectively protect the traditional Chinese medicine compound. This paper describes the creativity of the patent application for the invention of traditional Chinese medicine compound prescription and the creativity of the patent application for the traditional Chinese medicine compound method. In the third part, the author first clarifies the current situation of patent infringement of traditional Chinese medicine compound patent, and then discusses the methods of patent infringement of traditional Chinese medicine compound patent infringement, and then enumerates the principles of the patent infringement recognition of traditional Chinese medicine compound prescription after clarifying its importance. And according to the principle of traditional Chinese medicine recurrence specific situation was analyzed. In this paper, the general principle and special principle are used to explain the various cases of compound patent. At the same time, the other key principles of patent infringement, a variety of defenses are briefly expounded. Finally combined with the characteristics of traditional Chinese medicine compound to establish the appropriate standard of patent infringement of traditional Chinese medicine compound: it plays a positive role in the adjustment of some articles in the compound patent law. The fourth and fifth parts, discuss the policy of patent protection of Chinese traditional Chinese medicine compound, analyze the advanced experience of foreign countries, sum up the meaningful enlightenment to the patent protection of Chinese compound medicine. We should strengthen the consciousness of patent protection of traditional Chinese medicine compound, establish the standard of infringement according to the characteristics of patent of traditional Chinese medicine, apply the lower auditing standard, and establish a perfect legal system of patent protection of traditional Chinese medicine. In conclusion, the conclusion is summarized from the above analysis and research, and it is pointed out that the degree of innovation in the field of traditional Chinese medicine compound invention is not high at present, and the standard should be properly lowered when conducting the examination of the three properties of the compound patent. It should be realized that compound protection is a systematic project, and its protection needs to rely on a comprehensive way to form the patent protection network of traditional Chinese medicine compound. The patent protection of Chinese traditional Chinese medicine compound must proceed from its own characteristics and draw on the patent protection system of traditional Chinese medicine compound with Chinese characteristics on the basis of appropriate reference to foreign patent protection.
