【摘要】：植物品種是農(nóng)業(yè)的基礎(chǔ),改善現(xiàn)有植物品種并培育新品種是現(xiàn)代農(nóng)業(yè)快速發(fā)展的重要舉措。知識經(jīng)濟(jì)的繁榮促進(jìn)了知識產(chǎn)權(quán)制度的產(chǎn)生與發(fā)展。植物新品種權(quán)作為一種重要的創(chuàng)造性權(quán)利,作為農(nóng)業(yè)知識產(chǎn)權(quán)的重要組成部分,正日益融入國際知識產(chǎn)權(quán)保護(hù)的體系。植物新品種保護(hù)是國家整體知識產(chǎn)權(quán)戰(zhàn)略的重要一環(huán)。我國的植物新品種保護(hù)雖然起步較晚,但總體上呈現(xiàn)出蓬勃發(fā)展,不斷成熟和完善的趨勢。隨著經(jīng)濟(jì)全球化和知識經(jīng)濟(jì)的日益深入,中國的植物新品種保護(hù)不可避免的融入國際植物新品種保護(hù)的主體,這既是機(jī)遇,也是挑戰(zhàn)。本文旨在闡述植物新品種保護(hù)的基本理論和核心問題,勾勒當(dāng)前國際植物新品種保護(hù)的輪廓,發(fā)現(xiàn)我國植物新品種保護(hù)存在的問題,為我國植物新品種保護(hù)的發(fā)展與完善提出自己的建議。 文章的結(jié)構(gòu)包括四個(gè)方面：基礎(chǔ)理論、國際保護(hù)、國內(nèi)保護(hù)和制度完善. 第一部分主要闡釋植物新品種的基本理論和基本問題,幫助我們對植物新品種有一個(gè)清晰準(zhǔn)確的把握。 第二部分別從國際組織和條約、發(fā)達(dá)國家保護(hù)制度和生物技術(shù)的新挑戰(zhàn)三個(gè)方面勾勒植物新品種國際保護(hù)的框架和現(xiàn)狀。 第三部分介紹我國植物新品種保護(hù)的歷史、發(fā)展現(xiàn)狀和基本制度,并提出加入91文本的可行性這一問題,銜接國際保護(hù)這一層面。 第四部分分析我國現(xiàn)行保護(hù)制度的不足,剖析國際保護(hù)的理念與思路,提出自己對完善我國植物新品種保護(hù)制度的建議。
[Abstract]:Plant varieties are the basis of agriculture. Improving existing plant varieties and cultivating new varieties are important measures for the rapid development of modern agriculture. The prosperity of knowledge economy promotes the emergence and development of intellectual property system. As an important creative right and an important part of agricultural intellectual property rights, new plant variety rights are increasingly integrated into the system of international intellectual property protection. The protection of new plant varieties is an important part of the country's overall intellectual property strategy. Although the protection of new plant varieties in our country started late, it showed a trend of vigorous development, maturity and perfection. With the development of economic globalization and knowledge economy, the protection of new plant varieties in China is inevitably integrated into the main body of international protection of new plant varieties, which is both an opportunity and a challenge. The purpose of this paper is to expound the basic theory and core problems of the protection of new plant varieties, outline the current international protection of new plant varieties, and find out the problems existing in the protection of new varieties of plants in China. Some suggestions are put forward for the development and improvement of new plant varieties protection in China. The structure of the article includes four aspects: basic theory, international protection, domestic protection and institutional perfection. The first part mainly explains the basic theory and basic problems of new plant varieties, which helps us to have a clear and accurate grasp of new plant varieties. The second part outlines the framework and current situation of international protection of new plant varieties from three aspects: international organizations and treaties, protection systems of developed countries and new challenges of biotechnology. The third part introduces the history, current situation and basic system of new plant variety protection in China, and puts forward the feasibility of joining 91 text to link up with international protection. The fourth part analyzes the deficiency of the current protection system of our country, analyzes the idea and train of thought of international protection, and puts forward some suggestions for perfecting the protection system of new plant varieties in our country.
