【摘要】：目的:本研究在對中藥飲片炮制技術(shù)專利現(xiàn)狀研究的基礎(chǔ)上,通過在專利檢索平臺對中藥飲片炮制技術(shù)相關(guān)專利文獻(xiàn)進(jìn)行檢索,結(jié)合定量研究和定性研究,具體分析專利總體趨勢(申請總量,授權(quán)量,授權(quán)比率),炮制方法專利申請人情況,合作專利申請以及IPC(國際專利分類)分布,結(jié)合專利說明書和權(quán)力要求書對專利文本信息進(jìn)一步分析炮制技術(shù)專利的技術(shù)發(fā)展、專利保護(hù)范圍、專利布局、專利質(zhì)量等。將專利制度與傳統(tǒng)炮制技術(shù)的內(nèi)容結(jié)合起來,從專利性的角度出發(fā),研究目前我國中藥飲片炮制技術(shù)專利保護(hù)現(xiàn)狀,分析我國炮制技術(shù)專利申請的現(xiàn)狀及存在問題,以期引起對炮制方法專利的重視,針對我國炮制技術(shù)專利的現(xiàn)狀與存在的問題,研究炮制技術(shù)專利保護(hù)策略,為中藥飲片炮制技術(shù)專利保護(hù)提出對策建議。方法:1.文獻(xiàn)研究法。通過萬方、維普、中國知網(wǎng)(CNKI)等中文期刊網(wǎng)站查閱我國中藥飲片炮制技術(shù)的發(fā)展現(xiàn)狀,炮制技術(shù)領(lǐng)域知識產(chǎn)權(quán)保護(hù)現(xiàn)狀及存在問題,中醫(yī)藥專利保護(hù)等相關(guān)文獻(xiàn)。了解我國炮制技術(shù)領(lǐng)域?qū)＠暾垹顩r,專利保護(hù)現(xiàn)狀,炮制領(lǐng)域研究焦點(diǎn)問題及研究趨勢,學(xué)習(xí)專利檢索、專利分析的常用方法,為后續(xù)研究的開展奠定理論基礎(chǔ)。2.專利檢索法。利用廣東省專利大數(shù)據(jù)應(yīng)用服務(wù)系統(tǒng)、國家知識產(chǎn)權(quán)局專利檢索及分析平臺、SOOPAT專利數(shù)據(jù)庫、中國知識產(chǎn)權(quán)網(wǎng)等專利數(shù)據(jù)庫進(jìn)行檢索,以關(guān)鍵詞作為主要檢索手段,獲取得到專利信息。將搜集的信息進(jìn)行匯總,對檢索結(jié)果進(jìn)行二次篩選和人工除雜,根據(jù)研究需要的指標(biāo),對符合條件的專利數(shù)據(jù),進(jìn)行搜索、整理和分析。3.定量分析法。采用EXCEL2007,將數(shù)據(jù)樣本導(dǎo)入,建立炮制專利數(shù)據(jù)庫。本研究針對炮制方法專利申請進(jìn)行總體申請情況分析、年申請量及授權(quán)量趨勢分析、主要申請人分析、合作專利申請情況分析、炮制技術(shù)領(lǐng)域IPC分類構(gòu)成以及結(jié)合專利文本信息對炮制技術(shù)內(nèi)容等情況進(jìn)行統(tǒng)計與分析,挖掘炮制方法專利申請狀況及專利布局的相關(guān)信息。4.定性分析法。利用具體專利說明書,權(quán)利要求書等內(nèi)容,運(yùn)用數(shù)據(jù)挖掘等手段歸納整理專利文獻(xiàn)信息的內(nèi)部特征,分析專利技術(shù)及其功效間的對應(yīng)關(guān)系,權(quán)利要求范圍,專利質(zhì)量、技術(shù)發(fā)展趨勢、發(fā)現(xiàn)專利權(quán)人技術(shù)領(lǐng)域和研發(fā)實力,通過內(nèi)在質(zhì)的變化來反映技術(shù)的發(fā)展?fàn)顩r與發(fā)展趨勢。結(jié)果:通過對炮制技術(shù)專利申請狀況進(jìn)行分析,得出如下結(jié)果:炮制方法專利申請量較少,授權(quán)率不高;大專院校、科研院所的研發(fā)優(yōu)勢未能充分發(fā)揮,合作專利較少。以成都中醫(yī)藥大學(xué)和濟(jì)南康眾醫(yī)藥科技開發(fā)有限公司為例,對兩所單位專利保護(hù)狀況進(jìn)行分析,專利的技術(shù)內(nèi)容上看,成都中醫(yī)藥大學(xué)在研發(fā)實力、專利質(zhì)量、專利布局、專利保護(hù)等方面實力較強(qiáng),濟(jì)南康眾醫(yī)藥科技開發(fā)有限公司在中藥飲片炮制技術(shù)領(lǐng)域的專利申請缺乏新穎性和創(chuàng)造性,專利質(zhì)量低,涉及專利保護(hù)的范圍較小,研發(fā)實力不強(qiáng)。從整體上看,近年來炮制技術(shù)領(lǐng)域仍處于較好的發(fā)展時期,專利申請量呈現(xiàn)逐年遞增的情況,但仍面臨著授權(quán)率低,專利質(zhì)量不高、市場導(dǎo)向不強(qiáng)等問題。結(jié)論:目前,我國中藥飲片炮制技術(shù)領(lǐng)域?qū)＠Ｗo(hù)存在的問題如下:炮制技術(shù)并行的專利保護(hù)和行政保護(hù)制度在實踐中存在沖突;炮制技術(shù)專利新穎性和創(chuàng)造性不高導(dǎo)致專利質(zhì)量低下;專利申請文件的撰寫水平還有待提高;大專院校和科研院所的研發(fā)實力還沒有充分發(fā)揮;專利的市場轉(zhuǎn)化率較低,產(chǎn)學(xué)研聯(lián)合還不夠深入;專利布局不合理等。針對上述問題,從宏觀上講要相關(guān)政策法規(guī)的制定以及配套細(xì)則的完善,加強(qiáng)對大專院校和科研院所的引導(dǎo),構(gòu)建產(chǎn)學(xué)研聯(lián)盟提高專利轉(zhuǎn)化率,完善對中醫(yī)藥領(lǐng)域?qū)＠麑彶闃?biāo)準(zhǔn),提高專利文件撰寫水平。從炮制方法專利保護(hù)看,應(yīng)當(dāng)結(jié)合新技術(shù),采用新設(shè)備,依靠創(chuàng)新提升炮制技術(shù)競爭力;將炮制專利技術(shù)從傳統(tǒng)配伍轉(zhuǎn)變?yōu)榛瘜W(xué)溶出的研究;對中藥炮制技術(shù)進(jìn)行二次開發(fā),拓寬炮制技術(shù)專利申請的領(lǐng)域;對需要涉及重大意義需要保密的專利進(jìn)行保密專利申請;合理結(jié)合中藥品種保護(hù)和專利保護(hù),制定中藥保護(hù)的立體保護(hù)策略。
[Abstract]:Objective: on the basis of the research on the technology patent of Chinese herbal decoction pieces, this paper searches the patent literature of Chinese herbal medicine processing technology by the patent retrieval platform, combines quantitative research and qualitative research, and analyzes the general trend of patent (the amount of application, the amount of power, the ratio of authorization), and the application of the patent applicants. The application of cooperation patents and the distribution of IPC (International Patent Classification), combined with the patent instructions and power requirements, further analyses the technical development of the patent text information, the scope of patent protection, the distribution of patent and the quality of the patent. The patent system is combined with the content of the traditional processing technology, from the patentability point of view. This paper studies the current status of patent protection of Chinese herbal medicine processing technology and analyses the current situation and existing problems of the patent application in China, in order to arouse the attention to the patent of the processing method, and to study the patent protection strategy of the processing technology patent for the patent protection of Chinese herbal medicine. Conclusion: there are some problems in the patent protection of Chinese herbal medicine processing technology in the field of Chinese medicine. Not high creativity leads to low quality of patent; the writing level of patent application documents remains to be improved; the R & D strength of universities and scientific research institutes has not been fully developed; the conversion rate of patent market is low, the alliance of production and research and research is not deep enough; the distribution of patent is not reasonable.
