【摘要】：進(jìn)入網(wǎng)絡(luò)時代后，隨著各種新興網(wǎng)絡(luò)數(shù)字技術(shù)的發(fā)展，網(wǎng)絡(luò)給人類社會帶來了巨大的收益，它不僅豐富了人們的精神文化生活，而且還給全球經(jīng)濟(jì)發(fā)展帶來了革命性的驅(qū)動力。而與此同時，在日新月異的網(wǎng)絡(luò)環(huán)境下，知識產(chǎn)權(quán)保護(hù)卻受到了前所未有的沖擊。針對網(wǎng)絡(luò)環(huán)境帶來的各種新問題和新挑戰(zhàn)，從國際組織到各主權(quán)國家，都在積極地完善知識產(chǎn)權(quán)立法、制定應(yīng)對機(jī)制，以適應(yīng)這個時代的要求。在這個過程中，網(wǎng)絡(luò)知識產(chǎn)權(quán)這一新興事物逐漸從傳統(tǒng)知識產(chǎn)權(quán)中衍生而出成為了近些年來知識產(chǎn)權(quán)領(lǐng)域關(guān)注和研究的焦點(diǎn)。 現(xiàn)實中一個標(biāo)志現(xiàn)象就是，在司法實踐中，法院受理的涉及網(wǎng)絡(luò)知識產(chǎn)權(quán)的侵權(quán)糾紛數(shù)量逐年遞增，已經(jīng)占據(jù)了知識產(chǎn)權(quán)案件的半壁江山。由于網(wǎng)絡(luò)所具有的即時性、虛擬性、變動性等特征，使得網(wǎng)絡(luò)知識產(chǎn)權(quán)侵權(quán)糾紛的爭議焦點(diǎn)與傳統(tǒng)知識產(chǎn)權(quán)案件有所不同，而且也造成了訴訟當(dāng)事人對其主張的事實難以舉證的問題。 而保全證據(jù)公證則是解決這一問題的一個有效途徑。我國公證制度雖然起步較晚，但在《民事訴訟法》及《公證法》的制度支撐下，已經(jīng)建立起了具有公信力的證明體系，公證證據(jù)的證明效力也在理論和實踐中得到了驗證。保全證據(jù)公證更是以其豐富的應(yīng)用方法，嚴(yán)謹(jǐn)?shù)淖C明形式成為了網(wǎng)絡(luò)知識產(chǎn)權(quán)侵權(quán)糾紛中最為主要的取證方式。本文旨在通過對網(wǎng)絡(luò)知識產(chǎn)權(quán)及其侵權(quán)糾紛以及保全證據(jù)公證制度的研究分析，歸納總結(jié)出保全證據(jù)公證在網(wǎng)絡(luò)知識產(chǎn)權(quán)侵權(quán)糾紛中的具體應(yīng)用方式。在此基礎(chǔ)上，，再對網(wǎng)絡(luò)知識產(chǎn)權(quán)環(huán)境下公證保護(hù)的創(chuàng)新與完善提出建議。本文共分四個部分： 第一章先是闡釋網(wǎng)絡(luò)知識產(chǎn)權(quán)的概念和特征，并分節(jié)介紹網(wǎng)絡(luò)知識產(chǎn)權(quán)的具體內(nèi)容和立法現(xiàn)狀。而后對公證在網(wǎng)絡(luò)知識產(chǎn)權(quán)環(huán)境下的保護(hù)現(xiàn)狀和存在的問題進(jìn)行探討； 第二章是在第一章的基礎(chǔ)之上先對現(xiàn)實司法實踐中網(wǎng)絡(luò)知識產(chǎn)權(quán)侵權(quán)糾紛所涉及的侵權(quán)行為主體、侵權(quán)方法及訴訟中的爭議焦點(diǎn)進(jìn)行闡述分析。而后再對公證制度及保全證據(jù)公證的概念、特征及類型進(jìn)行介紹； 第三章以網(wǎng)絡(luò)知識產(chǎn)權(quán)侵權(quán)糾紛的舉證要點(diǎn)入手，從證明網(wǎng)絡(luò)知識產(chǎn)權(quán)權(quán)屬、證明侵權(quán)行為事實以及侵權(quán)損害賠償數(shù)額三個方面具體闡釋保全證據(jù)公證的具體應(yīng)用方法； 第四章從網(wǎng)絡(luò)知識產(chǎn)權(quán)公證保護(hù)完善的具體落實和對實務(wù)的建議兩個部分進(jìn)行具體闡述。
[Abstract]:After entering the network age, with the development of various new network digital technologies, the network has brought enormous benefits to the human society. It not only enriches people's spiritual and cultural life, but also brings revolutionary driving force to the development of global economy. At the same time, in the rapidly changing network environment, intellectual property protection has been unprecedented impact. In view of the new problems and challenges brought about by the network environment, from international organizations to sovereign countries, they are actively perfecting the legislation of intellectual property rights and formulating corresponding mechanisms to meet the requirements of the times. In this process, network intellectual property, as a new thing, has gradually become the focus of attention and research in the field of intellectual property in recent years. A sign phenomenon in reality is that in judicial practice, the number of infringement disputes involving network intellectual property rights accepted by the court is increasing year by year, which has already occupied half of the intellectual property rights cases. Because of the real-time, fictitious and changeable characteristics of the network, the dispute focus of the network intellectual property infringement is different from the traditional intellectual property rights case. And also caused the litigant to its claim of the facts difficult to prove the problem. The notarization of preservation evidence is an effective way to solve this problem. Although the notarization system of our country started relatively late, under the support of "Civil procedure Law" and "notarization Law", a credible proof system has been established, and the validity of notarization evidence has also been verified in theory and practice. Preservation of evidence notarization with its rich application, rigorous form of proof has become the network intellectual property rights infringement dispute the most important way to obtain evidence. The purpose of this paper is to sum up the concrete application of preservation evidence notarization in network intellectual property infringement disputes through the research and analysis of network intellectual property rights and the notarization system of preservation evidence. On this basis, the innovation and improvement of notarization protection under the environment of network intellectual property rights are put forward. This paper is divided into four parts: The first chapter first explains the concept and characteristics of network intellectual property, and introduces the specific content and legislative status of network intellectual property. Then it discusses the current situation and existing problems of notarization protection under the environment of network intellectual property rights. The second chapter is based on the first chapter of the real judicial practice of network intellectual property rights infringement disputes involved in the infringement of the main body, tort methods and the focus of disputes in litigation are analyzed. Then it introduces the concept, characteristics and types of notarization system and preservation evidence notarization. The third chapter starts with the main points of proof of network intellectual property infringement dispute, and explains the concrete application methods of preserving evidence notarization from three aspects: proving the ownership of network intellectual property right, proving the fact of infringement and the amount of compensation for tort damage. The fourth chapter elaborates the concrete implementation of network intellectual property notarization protection and the practical suggestions.
