【摘要】:當(dāng)前,經(jīng)濟(jì)全球化和國際產(chǎn)業(yè)分工不斷深入,新一輪科技革命與產(chǎn)業(yè)變革孕育興起,世界經(jīng)濟(jì)正加速轉(zhuǎn)型升級,知識產(chǎn)權(quán)在全球經(jīng)濟(jì)發(fā)展中的戰(zhàn)略性地位日益凸顯,世界各國愈加重視專利等知識產(chǎn)權(quán)的保護(hù)。全球知識產(chǎn)權(quán)和市場競爭的發(fā)展呈現(xiàn)出新形勢,即創(chuàng)新對專利保護(hù)的需求更加迫切、國外專利技術(shù)競爭加劇和專利保護(hù)濫用多發(fā)等。針對上述新形勢,深入開展企業(yè)專利戰(zhàn)略研究,將有助于我國企業(yè)掌握自身的優(yōu)、劣勢和面臨的機(jī)遇與威脅,制定出適合企業(yè)自身特點(diǎn)的專利戰(zhàn)略,提高企業(yè)專利戰(zhàn)略的科學(xué)性、針對性和有效性,加快企業(yè)資源向自主知識產(chǎn)權(quán)和核心競爭力的轉(zhuǎn)變,從而提升創(chuàng)新能力,優(yōu)化專利布局,降低市場風(fēng)險,實現(xiàn)可持續(xù)的競爭優(yōu)勢和經(jīng)濟(jì)效益,并為我國企業(yè)專利戰(zhàn)略的具體實踐提供借鑒。本文以國內(nèi)活塞環(huán)行業(yè)的領(lǐng)軍企業(yè)S公司為例,針對S公司缺乏系統(tǒng)化專利戰(zhàn)略的問題,運(yùn)用文獻(xiàn)研究、對比研究、案例分析、調(diào)查研究、定性與定量研究相結(jié)合等方法,重點(diǎn)研究了S公司專利戰(zhàn)略的定位、制定及實施的保障措施。本文首先總結(jié)了國內(nèi)外學(xué)者在企業(yè)專利戰(zhàn)略的概念、分類、特點(diǎn)、意義、影響因素、實證研究與應(yīng)用等方面的研究進(jìn)展與成果。其次,歸納了專利戰(zhàn)略、戰(zhàn)略管理的相關(guān)概念,以及相關(guān)研究方法與工具。接著,從專利的視角,運(yùn)用PEST分析法、五力分析模型和專利信息分析方法分析了 S公司的宏觀環(huán)境、行業(yè)競爭環(huán)境和主要競爭對手,并從資源、能力等方面詳細(xì)分析了S公司的內(nèi)部環(huán)境。在此基礎(chǔ)上,分析和歸納了 S公司的優(yōu)劣勢和面臨的機(jī)遇、威脅,運(yùn)用SWOT矩陣分析完成了 S公司專利戰(zhàn)略的定位與制定,并提出了實施該專利戰(zhàn)略的保障措施。本文提出的結(jié)論是:根據(jù)S公司在國內(nèi)外市場所處的不同競爭地位,即在國內(nèi)市場處于行業(yè)領(lǐng)先者地位,在國外市場處于追隨者地位,S公司應(yīng)在國內(nèi)外市場分別制定不同的專利戰(zhàn)略。S公司在國內(nèi)應(yīng)采取以進(jìn)攻為主的SO戰(zhàn)略,主要包括基礎(chǔ)專利戰(zhàn)略、委托開發(fā)專利戰(zhàn)略、產(chǎn)品輸出專利申請戰(zhàn)略和專利標(biāo)準(zhǔn)結(jié)合戰(zhàn)略;在國外采取以防御為主、攻防兼顧的WO戰(zhàn)略,主要包括追隨型專利開發(fā)戰(zhàn)略,以繞開對方專利為主的專利防御戰(zhàn)略,以專利引進(jìn)和失效專利應(yīng)用為主的專利實施戰(zhàn)略,和以取消對方專利權(quán)、證明先用權(quán)為主的專利防御戰(zhàn)略。同時,為確保該專利戰(zhàn)略的順利實施,制定了基礎(chǔ)性保障措施和分別針對國內(nèi)、國外專利戰(zhàn)略的專門保障措施。
[Abstract]:At present, with the deepening of economic globalization and international industrial division, a new round of scientific and technological revolution and industrial transformation are emerging, the world economy is accelerating the transformation and upgrading, and the strategic position of intellectual property rights in the global economic development is becoming increasingly prominent. Countries all over the world pay more and more attention to the protection of intellectual property rights such as patents. The development of global intellectual property rights and market competition presents a new situation, that is, the demand of innovation for patent protection is more urgent, foreign patent technology competition intensifies and patent protection abuse is frequent. In view of the above new situation, it will be helpful for Chinese enterprises to grasp their own advantages, disadvantages, opportunities and threats, and formulate patent strategies suitable for their own characteristics. Improving the scientific nature, pertinence and effectiveness of enterprise patent strategy, speeding up the transformation of enterprise resources to independent intellectual property rights and core competitiveness, thus enhancing innovation ability, optimizing patent layout, and reducing market risks, To realize sustainable competitive advantage and economic benefit, and to provide reference for the practice of patent strategy of Chinese enterprises. This paper takes S Company, the leading enterprise in the domestic piston ring industry, as an example, aiming at the lack of systematic patent strategy of S Company, using the methods of literature research, comparative study, case analysis, investigation and research, combination of qualitative and quantitative research, etc. Focus on S company patent strategy positioning, formulation and implementation of protection measures. This paper first summarizes the research progress and achievements of domestic and foreign scholars in the concept, classification, characteristics, significance, influencing factors, empirical research and application of enterprise patent strategy. Secondly, the patent strategy, strategic management concepts, and related research methods and tools are summarized. Then, from the perspective of patent, using PEST analysis method, five-force analysis model and patent information analysis method, the paper analyzes the macro environment, industry competition environment and main competitors of S Company, and analyzes the resources. Ability and other aspects of the detailed analysis of S company's internal environment. On this basis, the advantages and disadvantages of S Company and the opportunities and threats faced by S Company are analyzed and summarized. The positioning and formulation of S Company's patent strategy are completed by using SWOT matrix analysis, and the safeguard measures to implement the patent strategy are put forward. The conclusion of this paper is as follows: according to the different competitive position of S Company in the domestic and foreign markets, that is to say, S Company is in the leading position of the industry in the domestic market. In the position of follower in the foreign market, S company should make different patent strategy in domestic and foreign markets. S company should adopt so strategy which is mainly offensive in China, including basic patent strategy, commissioned development patent strategy. Product export patent application strategy and patent standard combination strategy; WO strategy in foreign countries, which is mainly defensive, offensive and defensive, mainly includes following patent development strategy, and bypassing the other side patent mainly patent defense strategy, Patent implementation strategy based on patent introduction and invalid patent application, and patent defense strategy by cancelling the other party's patent right and proving the preemptive right. At the same time, in order to ensure the smooth implementation of the patent strategy, the basic safeguard measures and the special safeguard measures for domestic and foreign patent strategies are formulated.
