【摘要】：植物新品種保護即植物新品種權(quán)是國家知識產(chǎn)權(quán)戰(zhàn)略和科技興農(nóng)戰(zhàn)略的重要組成部分,而種業(yè)企業(yè)是植物新品種培育和保護的重要主體和基礎(chǔ)力量,正確的使用好品種權(quán)可充分挖掘科技創(chuàng)新潛力,有利于推進民族種業(yè)和國際種子貿(mào)易的發(fā)展。江西是農(nóng)業(yè)大省,擁有巨大的種子市場和需求,種業(yè)企業(yè)的植物新品種權(quán)保護不僅影響著種業(yè)企業(yè)自身在國內(nèi)國際的市場競爭力,而且影響著江西省糧食產(chǎn)量、農(nóng)民收入和農(nóng)業(yè)的發(fā)展。本文通過對植物新品權(quán)保護制度、保護模式、種業(yè)企業(yè)植物新品種權(quán)保護方面進行文獻整理,從企業(yè)視角對江西省植物新品權(quán)保護狀況進行分析。通過描述分析、比較分析、個案分析等方法,得出：江西省植物新品種產(chǎn)權(quán)意識薄弱,種業(yè)企業(yè)植物新品種權(quán)申請授權(quán)的地域差異非常大,龍頭種業(yè)企業(yè)有效的帶動了現(xiàn)代種業(yè)的發(fā)展,江西省植物新品種申請保護的品種構(gòu)成不盡合理。種業(yè)企業(yè)要獲得更好的發(fā)展,應(yīng)加強對植物新品種保護知識的宣傳,提高人們的知識產(chǎn)權(quán)保護意識；培育和發(fā)展種業(yè)科技企業(yè),提高其技術(shù)創(chuàng)新能力；培植知名品牌和龍頭企業(yè),組建若干種業(yè)“航空母艦”,提升經(jīng)營企業(yè)的綜合競爭力；制定更加完善的配套政策和激勵措施,采取多種手段,提高植物新品種權(quán)的申請量。
[Abstract]:The protection of new plant varieties, that is, the right of new plant varieties, is an important part of the national intellectual property strategy and the strategy of developing agriculture by science and technology, and the seed industry enterprises are the main body and basic force for the cultivation and protection of new plant varieties. The correct use of variety rights can fully tap the potential of scientific and technological innovation and promote the development of national seed industry and international seed trade. Jiangxi is a big agricultural province, which has a huge seed market and demand. The protection of new plant variety rights of seed enterprises not only affects the market competitiveness of seed enterprises at home and abroad, but also affects the grain output of Jiangxi Province. The income of farmers and the development of agriculture. This paper analyzes the status of the protection of new plant variety rights in Jiangxi province from the perspective of enterprises through literature review on the protection system, protection mode, and plant new variety right protection of seed industry enterprises. Through descriptive analysis, comparative analysis, case analysis and other methods, it is concluded that the awareness of property rights of new plant varieties in Jiangxi Province is weak, and the regional differences in the application authorization for new plant variety rights in seed enterprises are very large. The development of modern seed industry has been effectively promoted by the leading seed industry enterprises, and the variety composition of new plant varieties in Jiangxi Province is unreasonable. In order to obtain better development, seed industry enterprises should strengthen the propaganda of new plant variety protection knowledge, improve people's awareness of intellectual property protection, cultivate and develop seed industry science and technology enterprises, and improve their technological innovation ability. To cultivate well-known brands and leading enterprises, to set up a number of "aircraft carriers" in various industries, to enhance the comprehensive competitiveness of enterprises, to formulate more complete supporting policies and incentives, and to adopt various means to increase the number of applications for new plant variety rights.
