【摘要】：民間文學(xué)藝術(shù),是世界各國(guó)人民在長(zhǎng)期的文明發(fā)展過程所創(chuàng)造出來的文化結(jié)晶和智慧遺產(chǎn),是維系各民族生存發(fā)展的充足動(dòng)力和不竭源泉,同時(shí)也是現(xiàn)代社會(huì)進(jìn)行文化藝術(shù)創(chuàng)新和科學(xué)技術(shù)創(chuàng)新的文化基礎(chǔ)。因此,在國(guó)際上很早就重視從知識(shí)產(chǎn)權(quán)的層面上對(duì)民間文學(xué)藝術(shù)加以保護(hù)�！恫疇柲峁s》第十五條就明確規(guī)定要對(duì)民間文學(xué)藝術(shù)“作品”予以保護(hù),聯(lián)合國(guó)科教文組織和世界知識(shí)產(chǎn)權(quán)組織以及《班吉協(xié)定》和《阿拉伯著作權(quán)公約》也擴(kuò)大了民間文學(xué)藝術(shù)的保護(hù)對(duì)象,建議用知識(shí)產(chǎn)權(quán)特別法保護(hù)那些不是作品而得不到現(xiàn)代著作權(quán)法保護(hù)的要素。這些都表明國(guó)際社會(huì)對(duì)于民間文學(xué)藝術(shù)的法律保護(hù)是不遺余力的。 然而,隨著我國(guó)工業(yè)化進(jìn)程的不斷加快,大量的民間文學(xué)藝術(shù)面臨著失傳的危險(xiǎn)；另一方面,一些優(yōu)秀的民間文學(xué)藝術(shù)作品被剽竊、擅自使用、歪曲的現(xiàn)象時(shí)有發(fā)生。由于我國(guó)民間文學(xué)藝術(shù)的法律保護(hù)制度的缺失,大量的民間文學(xué)藝術(shù)作品因失去知識(shí)產(chǎn)權(quán)法律保障的而得不到有效的拯救和保存。 本文認(rèn)為對(duì)民間文學(xué)藝術(shù)應(yīng)該以傳統(tǒng)的知識(shí)產(chǎn)權(quán)保護(hù)為基礎(chǔ),同時(shí)加強(qiáng)特殊立法保護(hù),除了引言和結(jié)論之外,主要分為四個(gè)部分加以闡述。 第一部分,本文主要對(duì)民間文學(xué)藝術(shù)保護(hù)進(jìn)行概述。首先對(duì)民間文學(xué)藝術(shù)的界定加以重點(diǎn)闡述,一方面是由于民間文學(xué)藝術(shù)是一個(gè)比較抽象的日常用語(yǔ),所以說若要得到法律的保護(hù),就需要明確民間文學(xué)藝術(shù)的概念；另一方面,隨著民間文學(xué)藝術(shù)的發(fā)展,理論界的一些學(xué)者對(duì)其也有不同的理解,所以需要對(duì)此進(jìn)行了一個(gè)大致的探討和界定。本文認(rèn)為民間文學(xué)藝術(shù)是民俗的重要組成部分,所以說民間文學(xué)藝術(shù)包含了民間文學(xué)藝術(shù)作品。同時(shí),對(duì)民間文學(xué)藝術(shù)的特點(diǎn)及其知識(shí)產(chǎn)權(quán)法律保護(hù)的合理性加以闡述。 第二部分是我國(guó)民間文學(xué)藝術(shù)知識(shí)產(chǎn)權(quán)保護(hù)的現(xiàn)狀和存在問題。首先對(duì)我國(guó)民間文學(xué)藝術(shù)知識(shí)產(chǎn)權(quán)保護(hù)發(fā)展的現(xiàn)狀進(jìn)行了概括式的介紹,從保護(hù)模式,國(guó)家立法,地方立法等方面初步介紹了我國(guó)民間文學(xué)藝術(shù)知識(shí)產(chǎn)權(quán)保護(hù)的基本現(xiàn)狀；然后分析總結(jié)了我國(guó)民間文學(xué)藝術(shù)知識(shí)產(chǎn)權(quán)在保護(hù)過程中存在的一些問題和不足。 第三部分,闡述民間文學(xué)藝術(shù)知識(shí)產(chǎn)權(quán)法律保護(hù)的國(guó)際法淵源。主要從國(guó)際公約、區(qū)域性國(guó)際條約和聯(lián)合國(guó)框架下的保護(hù)三個(gè)層面進(jìn)行了分析,并介紹了部分國(guó)家在民間文學(xué)藝術(shù)法律保護(hù)方面的立法實(shí)踐,并以此為基礎(chǔ)探討了對(duì)我國(guó)的啟示。 第四部分,提出了我國(guó)民間文學(xué)藝術(shù)知識(shí)產(chǎn)權(quán)保護(hù)進(jìn)行完善的相關(guān)建議和構(gòu)想。首先是對(duì)我國(guó)現(xiàn)有知識(shí)產(chǎn)權(quán)制度完善的幾點(diǎn)建議,分別從著作權(quán)法、商標(biāo)法及其他知識(shí)產(chǎn)權(quán)法等三個(gè)方面進(jìn)行論述,同時(shí)建議國(guó)家立法部門加強(qiáng)對(duì)特別立法保護(hù)的理論研究,以待將來?xiàng)l件成熟時(shí),建立一個(gè)集各種特殊權(quán)力內(nèi)容為一體的特別立法保護(hù)制度,對(duì)我國(guó)的民間文學(xué)藝術(shù)保護(hù)作出應(yīng)有的貢獻(xiàn)。
[Abstract]:Folk literature and art, which are the cultural and intellectual heritage created by the people of all countries in the long period of civilization, are the sufficient power and inexhaustible source to maintain the survival and development of all ethnic groups. At the same time, it is also the cultural foundation of the innovation of culture and art and the innovation of science and technology in the modern society. The fifteenth articles of the Berne Convention clearly stipulate that the "works" of folk literature and art should be protected. The United Nations Organization for science and education, the world intellectual property organization, and the Bangui agreement and the Arabia copyright convention have also expanded the protection of folk literature and art. It is suggested that the special law of intellectual property should be used to protect the elements that are not protected by the modern copyright law that is not a work. All of these suggest that the international community will spare no effort in the legal protection of folk literature and art.
However, with the rapid development of China's industrialization, a large number of folk literature and art are facing the danger of loss; on the other hand, some outstanding folk literature and art works have been plagiarized, unauthorized use and distorted phenomena occur. A large number of folk literature and art are made due to the lack of legal protection system of Chinese folk literature and art. Products can not be effectively saved and preserved because they lose the legal protection of intellectual property rights.
This article holds that the folk literature and art should be based on the protection of traditional intellectual property rights and strengthen the special legislative protection. Besides the introduction and conclusion, it is mainly divided into four parts.
The first part is a summary of the protection of folk literature and art. First, the definition of folk literature and art is focused on. On the one hand, folk literature and art is a relatively abstract everyday language. Therefore, the concept of folk literature and art should be clearly defined if the protection of the law is to be obtained; on the other hand, with the people. The development of literature and art, and some scholars in the theorists have different understanding of it, so it is necessary to make a general discussion and definition. This article holds that folk literature and art are an important part of folk custom, so that folk literature and art include folk literature art works. The rationality of its legal protection of intellectual property rights is expounded.
The second part is the current situation and existing problems of intellectual property protection of folk literature and art in China. First, the present situation of the development of intellectual property protection of folk literature and art in China is briefly introduced. The basic status of the protection of intellectual property rights of Chinese folk literature and art is preliminarily introduced from the protection mode, national legislation and local legislation. Then, it analyzes and summarizes some problems and deficiencies in the process of protecting intellectual property rights of folk literature and art in China.
The third part expounds the origin of the international law of the legal protection of intellectual property of folk literature and art. It mainly analyzes the three aspects of the protection of the international convention, the regional international treaty and the United Nations Framework, and introduces the legislative practice of the legal protection of the folk literature and art in some countries, and probes into our country on the basis of this. Apocalypse.
In the fourth part, some suggestions and ideas are put forward to improve the intellectual property protection of folk literature and art in China. First, some suggestions are made to improve the existing intellectual property system in China, including three aspects, such as copyright law, trademark law and other intellectual property law, and suggestions on strengthening special legislation by the national legislative department. The theoretical study of protection should establish a special legislative protection system which integrates the various special powers and contents to make due contribution to the protection of the folk literature and art in our country.
