民間文學藝術知識產(chǎn)權保護研究

【摘要】:民間文學藝術,是世界各國人民在長期的文明發(fā)展過程所創(chuàng)造出來的文化結晶和智慧遺產(chǎn),是維系各民族生存發(fā)展的充足動力和不竭源泉,同時也是現(xiàn)代社會進行文化藝術創(chuàng)新和科學技術創(chuàng)新的文化基礎。因此,在國際上很早就重視從知識產(chǎn)權的層面上對民間文學藝術加以保護。《伯爾尼公約》第十五條就明確規(guī)定要對民間文學藝術“作品”予以保護,聯(lián)合國科教文組織和世界知識產(chǎn)權組織以及《班吉協(xié)定》和《阿拉伯著作權公約》也擴大了民間文學藝術的保護對象,建議用知識產(chǎn)權特別法保護那些不是作品而得不到現(xiàn)代著作權法保護的要素。這些都表明國際社會對于民間文學藝術的法律保護是不遺余力的。 然而,隨著我國工業(yè)化進程的不斷加快,大量的民間文學藝術面臨著失傳的危險;另一方面,一些優(yōu)秀的民間文學藝術作品被剽竊、擅自使用、歪曲的現(xiàn)象時有發(fā)生。由于我國民間文學藝術的法律保護制度的缺失,大量的民間文學藝術作品因失去知識產(chǎn)權法律保障的而得不到有效的拯救和保存。 本文認為對民間文學藝術應該以傳統(tǒng)的知識產(chǎn)權保護為基礎,同時加強特殊立法保護,除了引言和結論之外,主要分為四個部分加以闡述。 第一部分,本文主要對民間文學藝術保護進行概述。首先對民間文學藝術的界定加以重點闡述,一方面是由于民間文學藝術是一個比較抽象的日常用語,所以說若要得到法律的保護,就需要明確民間文學藝術的概念;另一方面,隨著民間文學藝術的發(fā)展,理論界的一些學者對其也有不同的理解,所以需要對此進行了一個大致的探討和界定。本文認為民間文學藝術是民俗的重要組成部分,所以說民間文學藝術包含了民間文學藝術作品。同時,對民間文學藝術的特點及其知識產(chǎn)權法律保護的合理性加以闡述。 第二部分是我國民間文學藝術知識產(chǎn)權保護的現(xiàn)狀和存在問題。首先對我國民間文學藝術知識產(chǎn)權保護發(fā)展的現(xiàn)狀進行了概括式的介紹,從保護模式,國家立法,地方立法等方面初步介紹了我國民間文學藝術知識產(chǎn)權保護的基本現(xiàn)狀;然后分析總結了我國民間文學藝術知識產(chǎn)權在保護過程中存在的一些問題和不足。 第三部分,闡述民間文學藝術知識產(chǎn)權法律保護的國際法淵源。主要從國際公約、區(qū)域性國際條約和聯(lián)合國框架下的保護三個層面進行了分析,并介紹了部分國家在民間文學藝術法律保護方面的立法實踐,并以此為基礎探討了對我國的啟示。 第四部分,提出了我國民間文學藝術知識產(chǎn)權保護進行完善的相關建議和構想。首先是對我國現(xiàn)有知識產(chǎn)權制度完善的幾點建議,分別從著作權法、商標法及其他知識產(chǎn)權法等三個方面進行論述,同時建議國家立法部門加強對特別立法保護的理論研究,以待將來條件成熟時,建立一個集各種特殊權力內(nèi)容為一體的特別立法保護制度,對我國的民間文學藝術保護作出應有的貢獻。
[Abstract]:Folk literature and art, which are the cultural and intellectual heritage created by the people of all countries in the long period of civilization, are the sufficient power and inexhaustible source to maintain the survival and development of all ethnic groups. At the same time, it is also the cultural foundation of the innovation of culture and art and the innovation of science and technology in the modern society. The fifteenth articles of the Berne Convention clearly stipulate that the "works" of folk literature and art should be protected. The United Nations Organization for science and education, the world intellectual property organization, and the Bangui agreement and the Arabia copyright convention have also expanded the protection of folk literature and art. It is suggested that the special law of intellectual property should be used to protect the elements that are not protected by the modern copyright law that is not a work. All of these suggest that the international community will spare no effort in the legal protection of folk literature and art.
However, with the rapid development of China's industrialization, a large number of folk literature and art are facing the danger of loss; on the other hand, some outstanding folk literature and art works have been plagiarized, unauthorized use and distorted phenomena occur. A large number of folk literature and art are made due to the lack of legal protection system of Chinese folk literature and art. Products can not be effectively saved and preserved because they lose the legal protection of intellectual property rights.
This article holds that the folk literature and art should be based on the protection of traditional intellectual property rights and strengthen the special legislative protection. Besides the introduction and conclusion, it is mainly divided into four parts.
The first part is a summary of the protection of folk literature and art. First, the definition of folk literature and art is focused on. On the one hand, folk literature and art is a relatively abstract everyday language. Therefore, the concept of folk literature and art should be clearly defined if the protection of the law is to be obtained; on the other hand, with the people. The development of literature and art, and some scholars in the theorists have different understanding of it, so it is necessary to make a general discussion and definition. This article holds that folk literature and art are an important part of folk custom, so that folk literature and art include folk literature art works. The rationality of its legal protection of intellectual property rights is expounded.
The second part is the current situation and existing problems of intellectual property protection of folk literature and art in China. First, the present situation of the development of intellectual property protection of folk literature and art in China is briefly introduced. The basic status of the protection of intellectual property rights of Chinese folk literature and art is preliminarily introduced from the protection mode, national legislation and local legislation. Then, it analyzes and summarizes some problems and deficiencies in the process of protecting intellectual property rights of folk literature and art in China.
The third part expounds the origin of the international law of the legal protection of intellectual property of folk literature and art. It mainly analyzes the three aspects of the protection of the international convention, the regional international treaty and the United Nations Framework, and introduces the legislative practice of the legal protection of the folk literature and art in some countries, and probes into our country on the basis of this. Apocalypse.
In the fourth part, some suggestions and ideas are put forward to improve the intellectual property protection of folk literature and art in China. First, some suggestions are made to improve the existing intellectual property system in China, including three aspects, such as copyright law, trademark law and other intellectual property law, and suggestions on strengthening special legislation by the national legislative department. The theoretical study of protection should establish a special legislative protection system which integrates the various special powers and contents to make due contribution to the protection of the folk literature and art in our country.
