【摘要】：隨著國(guó)際海事組織（IMO）制定的一系列國(guó)際造船新規(guī)范、新標(biāo)準(zhǔn)的實(shí)施，造船企業(yè)在國(guó)際國(guó)內(nèi)市場(chǎng)上的競(jìng)爭(zhēng)越來(lái)越激烈，且競(jìng)爭(zhēng)已由資本、資源和勞動(dòng)力轉(zhuǎn)向技術(shù)含量愈來(lái)愈占主導(dǎo)地位的創(chuàng)新技術(shù)的競(jìng)爭(zhēng)。創(chuàng)新技術(shù)的競(jìng)爭(zhēng)，實(shí)質(zhì)上是企業(yè)如何運(yùn)用法律手段與專有手段，合理選擇技術(shù)性知識(shí)產(chǎn)權(quán)的開(kāi)發(fā)方式，在不被競(jìng)爭(zhēng)對(duì)手掌握本企業(yè)技術(shù)的情形下，更好的使其處于市場(chǎng)優(yōu)勢(shì)地位的競(jìng)爭(zhēng)。 本文從中船重工造船企業(yè)技術(shù)性知識(shí)產(chǎn)權(quán)開(kāi)發(fā)方式選擇的角度進(jìn)行研討，將國(guó)內(nèi)外關(guān)于技術(shù)性知識(shí)產(chǎn)權(quán)開(kāi)發(fā)選擇的理論作為基礎(chǔ)，對(duì)技術(shù)性知識(shí)產(chǎn)權(quán)的開(kāi)發(fā)選擇理論進(jìn)行綜述，，從而能夠明晰企業(yè)進(jìn)行技術(shù)性知識(shí)產(chǎn)權(quán)開(kāi)發(fā)方式選擇的意義，并評(píng)述文章的創(chuàng)新點(diǎn)和寫(xiě)作思路。其次，深入分析了造船企業(yè)的特點(diǎn)；然后詳細(xì)闡述了技術(shù)性知識(shí)產(chǎn)權(quán)的開(kāi)發(fā)方式，即專利、專利與技術(shù)組合、技術(shù)秘密這三種方式及其適用情況；根據(jù)已有的理論從企業(yè)層面界定了企業(yè)技術(shù)性知識(shí)產(chǎn)權(quán)開(kāi)發(fā)方式選擇的概念，為后文的研究打下基礎(chǔ)。在這個(gè)基礎(chǔ)上，對(duì)中船重工集團(tuán)及中船重工造船企業(yè)進(jìn)行介紹；接著深入分析中船重工造船企業(yè)技術(shù)性知識(shí)產(chǎn)權(quán)開(kāi)發(fā)業(yè)績(jī)、存在的問(wèn)題及其成因，由此引出了下文關(guān)于中船重工造船企業(yè)技術(shù)性知識(shí)產(chǎn)權(quán)開(kāi)發(fā)方式選擇的研究。接著，文章重點(diǎn)研究了企業(yè)技術(shù)性知識(shí)產(chǎn)權(quán)開(kāi)發(fā)方式選擇因素的確定原則和專利與技術(shù)秘密的優(yōu)劣勢(shì)比較；根據(jù)上述原則和優(yōu)劣勢(shì)比較，深入研究企業(yè)技術(shù)管理、法律環(huán)境、行業(yè)競(jìng)爭(zhēng)、技術(shù)特征、企業(yè)戰(zhàn)略五個(gè)方面的相關(guān)因素對(duì)各開(kāi)發(fā)方式選擇的影響。運(yùn)用模糊評(píng)價(jià)法對(duì)中船重工造船企業(yè)技術(shù)性知識(shí)產(chǎn)權(quán)開(kāi)發(fā)方式進(jìn)行評(píng)價(jià)，并分析組合方式對(duì)中船重工造船企業(yè)的適用性。針對(duì)存在的問(wèn)題及所選擇的開(kāi)發(fā)方式，提出了中船重工造船企業(yè)技術(shù)性知識(shí)產(chǎn)權(quán)的開(kāi)發(fā)選擇改進(jìn)對(duì)策。
[Abstract]:With a series of new norms and standards of international shipbuilding developed by the International Maritime Organization (IMO), the competition of shipbuilding enterprises in the international and domestic markets has become more and more fierce, and the competition has been made by the capital. Resources and labor force shift to technological content more and more dominant innovative technology competition. The competition of innovative technology is, in essence, how an enterprise uses legal and proprietary means to rationally select the way of developing technical intellectual property rights, without being mastered by its competitors. A better competitive position in the market. In this paper, from the angle of the choice of the development mode of the technical intellectual property rights of the shipbuilding enterprises of China Shipbuilding Industry, taking the theory of the development and selection of the technical intellectual property rights at home and abroad as the basis, the development and selection theory of the technical intellectual property rights is summarized. Therefore, it can clarify the significance of the choice of the development mode of technical intellectual property rights, and comment on the innovation and writing ideas of the article. Secondly, the characteristics of shipbuilding enterprises are analyzed in depth, and then the development methods of technical intellectual property rights, namely patent, patent and technology combination, technology secret and their application are described in detail. According to the existing theories, this paper defines the concept of the choice of the development mode of the enterprise's technical intellectual property right from the enterprise level, which lays the foundation for the later research. On this basis, the paper introduces China Shipyard heavy Industry Group and China Shipyard heavy Industry Shipbuilding Enterprise, and then deeply analyzes the achievements, existing problems and causes of technical intellectual property development of CSI Shipbuilding Enterprises. This leads to the following research on the choice of technical intellectual property rights development mode for shipbuilding enterprises of China Shipyard heavy Industry. Then, the article focuses on the determination of the factors of the choice of the development mode of the enterprise's technical intellectual property rights and the comparison of the advantages and disadvantages of the patent and the technology secret, according to the above principles and the comparison of the advantages and disadvantages, the paper deeply studies the enterprise's technology management and legal environment. The influence of industry competition, technical characteristics and enterprise strategy on the choice of development methods. The method of fuzzy evaluation is used to evaluate the way of developing technical intellectual property rights of shipbuilding enterprises of heavy industry of China Shipyard, and the applicability of combination mode to shipbuilding enterprises of heavy industry is analyzed. In view of the existing problems and the selected development methods, this paper puts forward the countermeasures to improve the development and selection of the technical intellectual property rights of the shipbuilding enterprises of China Shipyard heavy Industry.
