【摘要】：當(dāng)前，我國知識產(chǎn)權(quán)行業(yè)發(fā)展迅猛，其中以專利發(fā)展尤甚，專利保護(hù)所受到的重視程度與時(shí)俱進(jìn)，專利申請數(shù)量也與日劇增，這也使得因?yàn)閷＠麢?quán)的保護(hù)所產(chǎn)生的糾紛愈來愈多。但是，面對企業(yè)和公民對于更便捷更完善的解決專利糾紛的極大呼吁，我國的專利糾紛解決制度顯示出了一定的滯后性，尤其在專利糾紛非訴訟程序（A DR）的解決層面上，比起發(fā)達(dá)國家，我國的在專利糾紛AD R上的服務(wù)相對落后，這均不利于我國專利產(chǎn)業(yè)的發(fā)展。 本文首先對AD R進(jìn)行先關(guān)介紹，，并從我國A DR服務(wù)市場現(xiàn)狀以及存在的可利用因素以論證我國存在建立專利民事糾紛A DR服務(wù)公司的現(xiàn)實(shí)基礎(chǔ)。本文隨后以武漢高新技術(shù)示范區(qū)——光谷為例，從法律法規(guī)層面、國家政策層面、法律服務(wù)市場層面、政府力量和民間力量多個(gè)層面論證在光谷率先建立專利糾紛A DR專門服務(wù)公司的可行性和可操作性。緊接著，本文對從光谷建立的專利糾紛AD R專門服務(wù)公司的輪廓進(jìn)行勾畫，從其法律地位、運(yùn)作模式、服務(wù)類型等方面詳細(xì)探討其模樣，以建立一個(gè)相對完整的法律服務(wù)公司整體。 本文最后分析了對于在我國建立的專利糾紛AD R服務(wù)公司所能依據(jù)的法律法規(guī)以及相應(yīng)的法律法規(guī)尚需完善的部分，以及對于服務(wù)公司服務(wù)人員的資質(zhì)認(rèn)證的法律規(guī)范問題進(jìn)行探討。本文得出現(xiàn)階段我國需要建立起自己的服務(wù)于專利糾紛A DR解決的服務(wù)公司，并且完全有條件和能力使其建立的相對完善，為了使所建立的公司發(fā)揮其應(yīng)有的作用，法律尚需在民間調(diào)解、仲裁、對AD R公司服務(wù)人員的資格規(guī)范上需進(jìn)行改革。
[Abstract]:At present, the intellectual property industry of our country develops rapidly, especially the patent development, the degree of attention paid to patent protection keeps pace with the times, and the number of patent applications increases sharply. This also causes more and more disputes arising from the protection of patent rights. However, in the face of the great appeal of enterprises and citizens for a more convenient and perfect solution to patent disputes, the patent dispute resolution system in our country has shown a certain lag, especially in the aspect of resolving patent disputes in non-litigation proceedings. Compared with the developed countries, our country's service in patent dispute AD R is relatively backward, which is not conducive to the development of our patent industry. This paper first introduces AD R, and proves the practical basis of the establishment of patent civil dispute A Dr service company in China from the current situation of A Dr service market and the available factors in our country. This paper then takes Wuhan High-tech demonstration Zone-Optical Valley as an example, from the level of laws and regulations, the level of national policy, the level of legal service market, The government and private forces demonstrate the feasibility and maneuverability of setting up patent dispute A Dr special service company in Optic Valley. Then, this paper outlines the outline of the patent dispute AD R specialized service company established from Optical Valley, and discusses its appearance in detail from the aspects of its legal status, operation mode, service type, etc. To establish a relatively complete legal services company as a whole. Finally, this paper analyzes the laws and regulations that the patent dispute AD R service company can be established in China and the relevant laws and regulations that need to be perfected. As well as the service company service personnel qualification certification legal norms are discussed. This paper draws the conclusion that our country needs to set up its own service company to solve patent dispute A Dr at the present stage, and has the condition and the ability to make it relatively perfect, in order to make the established company play its due role. The law needs to be reformed in civil mediation, arbitration and qualification of AD R service personnel.
