【摘要】：專(zhuān)利審查和公示是界定專(zhuān)利權(quán)權(quán)利范圍和行使權(quán)利的必要條件。引進(jìn)專(zhuān)利無(wú)效抗辯有利于盡早明確雙方的權(quán)利義務(wù)、減少程序拖沓。結(jié)合我國(guó)的知識(shí)產(chǎn)權(quán)法院建設(shè),可以先按實(shí)際需要建立幾個(gè)跨省級(jí)的知識(shí)產(chǎn)權(quán)法院,將專(zhuān)利等技術(shù)性案件的管轄權(quán)適當(dāng)集中,再通過(guò)專(zhuān)門(mén)立法賦予這些法院審理專(zhuān)利無(wú)效抗辯的職能,并為最終設(shè)立知識(shí)產(chǎn)權(quán)高級(jí)法院做好制度準(zhǔn)備。
[Abstract]:Patent examination and publicity are the necessary conditions to define the scope and exercise of patent rights. The introduction of patent invalidity defense is helpful to clarify the rights and obligations of both parties as soon as possible and to reduce delay in the process. In connection with the construction of intellectual property courts in our country, we can first set up several inter-provincial intellectual property courts according to the actual needs to appropriately concentrate the jurisdiction over technical cases such as patents. These courts are empowered by special legislation to try the defense of patent invalidity and to prepare for the establishment of the Supreme Court of intellectual property.
