【摘要】：當前中國經(jīng)濟快速發(fā)展,不斷提高的科學(xué)技術(shù)以及不斷增長和繁榮的文學(xué)藝術(shù),使得知識產(chǎn)權(quán)的地位日益突出,版權(quán)問題為知識產(chǎn)權(quán)法的重要內(nèi)容之一,對推動我國知識產(chǎn)權(quán)發(fā)展具有特殊的作用。版權(quán)許可對于保護原創(chuàng)作者的文學(xué)、藝術(shù)、科學(xué)作品以及與版權(quán)相關(guān)的權(quán)益,營造公平公正的法制環(huán)境有著重要的作用。但新的環(huán)境變化發(fā)展,過度的版權(quán)許可又不利于知識的傳播和分享,可能使創(chuàng)造出的新作品死板,沒有多元化發(fā)展,不利于傳播和共享知識,新的作品缺乏大膽創(chuàng)新。版權(quán)豁免可以使作品更好的得到創(chuàng)新、傳播與發(fā)展,使用者可以免費獲取使用版權(quán)人讓渡的部分財產(chǎn)權(quán)利,但必須合理使用和傳播共享作品,因此版權(quán)豁免也必須把握一定的度,否則容易造成"權(quán)利濫用"。版權(quán)豁免與版權(quán)許可之間必然發(fā)生沖突,如何更好地協(xié)調(diào)他們的沖突,創(chuàng)作和傳播有利于社會主義精神文明和物質(zhì)文明建設(shè)的作品,促進社會主義文化和科學(xué)事業(yè)更好的發(fā)展和繁榮,是值得我們研究的一個重要問題。為此,本文通過版權(quán)豁免與版權(quán)許可的相關(guān)概念,簡述了版權(quán)豁免相關(guān)的國際國內(nèi)規(guī)定,以及版權(quán)許可的相關(guān)內(nèi)容,通過分析,提出二者之間產(chǎn)生的沖突以及協(xié)調(diào)辦法。
[Abstract]:With the rapid development of China's economy, the continuous improvement of science and technology, and the growing and prosperous literature and art, the status of intellectual property rights has become increasingly prominent, and the issue of copyright is one of the important contents of intellectual property law. To promote the development of intellectual property rights in China has a special role. Copyright licensing plays an important role in the protection of literary, artistic, scientific works and copyright related rights and interests of the original creator, and in creating a fair and just legal environment. However, the new environment changes and development, the excessive copyright license is not conducive to the dissemination and sharing of knowledge, which may make the new works rigid, not diversified development, is not conducive to the dissemination and sharing of knowledge, the lack of bold innovation of new works. Copyright exemption can make the work better to be innovated, disseminated and developed. Users can obtain part of the property rights granted by the copyright owner free of charge, but they must reasonably use and disseminate the shared work. Therefore, copyright exemption must also grasp a certain degree, otherwise easy to cause "abuse of rights." There is bound to be a conflict between copyright exemption and copyright licensing. How to better coordinate their conflicts and create and disseminate works conducive to the construction of socialist spiritual and material civilization, Promoting better development and prosperity of socialist cultural and scientific undertakings is an important issue worthy of our study. Therefore, through the relevant concepts of copyright exemption and copyright license, this paper briefly introduces the international and domestic regulations related to copyright exemption, as well as the relevant contents of copyright license, and through analysis, puts forward the conflict between them and the methods of coordination.
