論我國地理標(biāo)志保護(hù)法律制度完善

【摘要】:地理標(biāo)志是最早的一種商標(biāo)類型,但作為國際公認(rèn)的獨(dú)立知識產(chǎn)權(quán),還是一個新生事物,各國也是最近才承認(rèn)和加以保護(hù)的。地理標(biāo)志是能夠給產(chǎn)品帶來高附加值的知識產(chǎn)權(quán)。無論是在哪一個國家,從已獲得地理標(biāo)志保護(hù)的產(chǎn)品來看,絕大多數(shù)受保護(hù)的產(chǎn)品均有很高的附加值。鑒于地理標(biāo)志在知識產(chǎn)權(quán)的重要地位,對其保護(hù)也成為WTO多哈談判的重要議題之一。 目前,我國地理標(biāo)志保護(hù)采取的是三條并列的保護(hù)途徑,即商標(biāo)法保護(hù)模式、地理標(biāo)志產(chǎn)品專門保護(hù)模式和農(nóng)產(chǎn)品地理標(biāo)志產(chǎn)品的專門保護(hù)模式。這種保護(hù)體制既有商標(biāo)保護(hù)模式也有專門保護(hù)模式,并將長期并存。因此,關(guān)鍵是如何協(xié)調(diào)好三種體制之間的關(guān)系,結(jié)合我國地理標(biāo)志保護(hù)的具體實(shí)踐,對這種制度做必要的調(diào)整和修正,使其揚(yáng)長避短,發(fā)揮最佳效用,F(xiàn)存地理標(biāo)志保護(hù)法律體制存在多頭管理、部門職責(zé)不清等問題,應(yīng)正確處理商標(biāo)與地理標(biāo)志之間的關(guān)系,建立地理標(biāo)志保護(hù)國家戰(zhàn)略、完善地理標(biāo)志的監(jiān)督機(jī)制、建立地理標(biāo)志產(chǎn)品國際領(lǐng)域維權(quán)機(jī)制,實(shí)現(xiàn)地理標(biāo)志保護(hù)的一體化。 本文立足于我國的地理標(biāo)志保護(hù)實(shí)際,分析了地理標(biāo)志保護(hù)法律制度存在的問題,提了出完善的建議。具體地從五個方面闡述了地理標(biāo)志基本理論,,國際組織與國際公約對地理標(biāo)志的保護(hù),各國國內(nèi)法對地理標(biāo)志的保護(hù)及啟示,我國地理標(biāo)志保護(hù)現(xiàn)狀及問題和我國地理標(biāo)志保護(hù)法律制度的完善建議。
[Abstract]:Geographical indication is one of the earliest trademark types, but as an internationally recognized independent intellectual property, it is still a new thing.Geographical indication is the intellectual property that can bring high added value to the product.In any country, most of the products protected by geographical indications have high added value.In view of the importance of geographical indications in intellectual property rights, its protection has also become one of the important issues in the WTO Doha negotiations.At present, the protection of geographical indications in our country adopts three parallel ways, that is, the protection mode of trademark law, the special protection mode of geographical indication products and the special protection mode of agricultural products.This protection system has both trademark protection mode and special protection mode, and will coexist for a long time.Therefore, the key is how to coordinate the relationship between the three systems, combine the specific practice of the protection of geographical indications in our country, and make necessary adjustments and amendments to this system, so as to make it develop its strengths and circumvent its weaknesses, and give full play to its best effect.The existing legal system for the protection of geographical indications has many problems, such as multiple management and unclear responsibilities of the departments. It is necessary to correctly handle the relationship between trademarks and geographical indications, establish a national strategy for the protection of geographical indications, and improve the supervision mechanism of geographical indications.To establish the international protection mechanism of geographical indication products and realize the integration of geographical indication protection.Based on the practice of geographical indication protection in China, this paper analyzes the problems existing in the legal system of geographical indication protection and puts forward some suggestions.The basic theory of geographical indications, the protection of geographical indications by international organizations and conventions, the protection of geographical indications by the domestic laws of various countries and their enlightenment are elaborated from five aspects.The present situation and problems of the protection of geographical indications in China and the suggestions for the perfection of the legal system of the protection of geographical indications in China.
