【摘要】：伴隨我國(guó)產(chǎn)業(yè)結(jié)構(gòu)和出口產(chǎn)品結(jié)構(gòu)的升級(jí)，出口產(chǎn)品科技含量提高，，我國(guó)出口產(chǎn)品遭受了越來越多的國(guó)外知識(shí)產(chǎn)權(quán)貿(mào)易壁壘。我國(guó)出口貿(mào)易中有關(guān)知識(shí)產(chǎn)權(quán)的糾紛已成為熱點(diǎn)問題。 本文在前人研究的基礎(chǔ)上，主要闡述了國(guó)外知識(shí)產(chǎn)權(quán)貿(mào)易壁壘的設(shè)置現(xiàn)狀，和我國(guó)遭受的狀況、分析了設(shè)置的經(jīng)濟(jì)學(xué)理論、設(shè)置動(dòng)因和我國(guó)中招的原因；并從實(shí)證研究的角度分析了知識(shí)產(chǎn)權(quán)貿(mào)易壁壘帶來的影響；最后從我國(guó)實(shí)際出發(fā)，提出了我國(guó)應(yīng)對(duì)國(guó)外知識(shí)產(chǎn)權(quán)貿(mào)易壁壘的策略建議。 本文主要框架結(jié)構(gòu)如下： 第一章，概述本文的研究背景與意義，介紹國(guó)內(nèi)外研究現(xiàn)狀。 第二章，闡述知識(shí)產(chǎn)權(quán)貿(mào)易壁壘的涵義、特征和主要表現(xiàn)形式。 第三章，介紹國(guó)際上知識(shí)產(chǎn)權(quán)貿(mào)易壁壘的主要制度，尤其是美國(guó)、歐盟等擁有知識(shí)產(chǎn)權(quán)優(yōu)勢(shì)的國(guó)家關(guān)于知識(shí)產(chǎn)權(quán)貿(mào)易壁壘的法律狀況，并分析這些國(guó)家設(shè)置和使用知識(shí)產(chǎn)權(quán)貿(mào)易壁壘的經(jīng)濟(jì)學(xué)理論及其動(dòng)因。 第四章，用具體數(shù)據(jù)和圖表闡述我國(guó)企業(yè)遭受知識(shí)產(chǎn)權(quán)貿(mào)易壁壘的現(xiàn)狀，用實(shí)證分析了遭受的影響，并分析產(chǎn)生的內(nèi)部原因和外部原因。 第五章，提出我國(guó)應(yīng)對(duì)知識(shí)產(chǎn)權(quán)貿(mào)易壁壘的策略，結(jié)合我國(guó)實(shí)際遭受的貿(mào)易壁壘情況，從宏微觀角度提出應(yīng)對(duì)的策略建議。
[Abstract]:With the upgrading of China's industrial structure and export product structure, the scientific and technological content of export products has increased. China's export products suffer more and more foreign intellectual property trade barriers, and disputes about intellectual property rights in China's export trade have become a hot issue. On the basis of previous studies, this paper mainly expounds the present situation of foreign intellectual property trade barriers, and the situation of our country, analyzes the economic theory of setting up, the motivation of setting up and the reasons of our country's success. From the perspective of empirical research, this paper analyzes the impact of trade barriers to intellectual property rights, and finally, from the reality of our country, puts forward some suggestions for our country to deal with foreign trade barriers to intellectual property rights. The main structure of this paper is as follows:. The first chapter summarizes the research background and significance of this paper, introduces the current research situation at home and abroad. The second chapter expounds the meaning, characteristics and main forms of intellectual property trade barriers. The third chapter introduces the international intellectual property trade barriers, especially the United States, the European Union and other countries with intellectual property advantages on intellectual property trade barriers to the legal situation, It also analyzes the economic theory and its motivation of setting up and using trade barriers to intellectual property rights in these countries. In the fourth chapter, the author uses concrete data and charts to explain the current situation of Chinese enterprises suffering from intellectual property trade barriers, and analyzes the internal and external causes with empirical analysis. In the fifth chapter, the author puts forward the strategies to deal with the trade barriers to intellectual property rights in our country, and puts forward some suggestions from the macro and micro angle according to the actual situation of trade barriers suffered by our country.
