【摘要】：合理使用制度又稱“自由使用”。是指在公平合理的范圍內(nèi),可以不經(jīng)著作權(quán)人的同意,也不必支付報酬而自由使用他人作品的一種著作權(quán)法律制度。知識產(chǎn)權(quán)法律制度將促進文學(xué)藝術(shù)與科學(xué)技術(shù)的進步與傳播視為核心價值所在。著作權(quán)法律制度作為知識產(chǎn)權(quán)法律制度的一部分,旨在促進文學(xué)藝術(shù)作品的不斷創(chuàng)作和連續(xù)傳播。信息網(wǎng)絡(luò)傳播技術(shù)的不斷更新與飛速發(fā)展下的網(wǎng)絡(luò)傳播環(huán)境給著作權(quán)法律制度帶來了信息時代背景下的特定挑戰(zhàn),同時也將為其帶來前所未有的發(fā)展機遇。著作權(quán)法所追求的目標之一即是協(xié)調(diào)創(chuàng)作者、使用者、傳播者之間的利益平衡,而通過利益的均衡促進文學(xué)藝術(shù)、科學(xué)技術(shù)事業(yè)的發(fā)展正是合理使用制度的價值目標。本文旨在通過探究網(wǎng)絡(luò)傳播環(huán)境中合理使用制度面臨的問題,在借鑒國外的相關(guān)規(guī)定與經(jīng)驗的基礎(chǔ)上,通過論證,進而從理論上提出完善我國著作權(quán)合理使用制度的思路與措施。本文的研究主要包含四個部分。第一部分主要講述著作權(quán)合理使用制度概述,包括含義、性質(zhì)以及起源。第二部分主要講述網(wǎng)絡(luò)環(huán)境對著作權(quán)合理使用制度的挑戰(zhàn)和沖擊。第三部分主要講述國外關(guān)于網(wǎng)絡(luò)環(huán)境下著作權(quán)合理使用制度的立法,以便給我國帶來借鑒和參考。第四部分主要是針對我國網(wǎng)絡(luò)環(huán)境下著作權(quán)合理使用制度存在的不足,提出完善的建議。
[Abstract]:The system of rational use, also known as "free use", means that, within the limits of fairness and reasonableness, without the consent of the copyright owner, A copyright legal system in which the work of others is freely used without payment. The intellectual property legal system regards the promotion of the advancement and dissemination of literature, art and science and technology as the core value. As part of the intellectual property legal system, The aim is to promote the continuous creation and continuous dissemination of literary and artistic works. The continuous updating of information network communication technology and the rapid development of the network communication environment bring specific challenges to the copyright legal system in the context of the information age. At the same time, it will also bring unprecedented development opportunities. One of the goals pursued by copyright Law is to coordinate the interests of creators, users and communicators, and to promote literature and art through the balance of interests. The development of science and technology is the value target of the rational use system. This paper aims to explore the problems faced by the rational use of the system in the network communication environment, on the basis of drawing lessons from the relevant regulations and experiences of foreign countries, and through demonstration, And then put forward the ideas and measures to perfect the system of the fair use of copyright in our country theoretically. The research of this paper mainly includes four parts. The first part mainly describes the outline of the system of fair use of copyright, including the meaning. The second part is mainly about the challenge and impact of the network environment on the fair use of copyright. The third part is mainly about the foreign legislation on the fair use of copyright under the network environment. In order to bring reference and reference to our country. The fourth part is mainly aimed at the shortcomings of the fair use of copyright system under the network environment of our country, put forward the perfect suggestion.
