翻唱音樂作品侵權問題研究

【摘要】:隨著現(xiàn)代社會的經濟快速發(fā)展,在人們錢包日益鼓起的同時,精神生活也日漸豐富,娛樂享受自然包含其中。近些年來,翻唱他人的音樂作品現(xiàn)象頻頻發(fā)生,而隨相關知識產權法的制定與實施,社會大眾的版權保護意識愈加增強。音樂作品權利人對自己的作品有了更多的“標示”意識,在面對侵犯自己合法權益的使用者時更多地選擇拿起法律的武器。 然而,隨著近幾年來日益增多的翻唱音樂作品侵權糾紛,很多問題也在翻唱音樂作品的侵權責任認定中暴露出來。本文主要就基于現(xiàn)有的幾種翻唱形式展開的對于翻唱音樂作品侵權問題的探討。全文分成四章對此問題進行了研究。 第一章主要是對音樂作品的翻唱的定義和翻唱的流行成因以及翻唱類型進行了探討。明確了翻唱的法律概念,道出翻唱流行的主要因素,將翻唱音樂作品進行區(qū)分。 第二章寫出了翻唱音樂作品的合理使用所需要的依據,主要對翻唱的侵權進行了界定,明確翻唱侵權造成的法律責任。就翻唱的幾種形式分別分析侵權界定問題以及在各自情形下侵權所應承擔的法律責任。 第三章主要就國外音樂作品保護現(xiàn)狀進行分析,從立法層面到著作權協(xié)會等各方運行機制指出頗具代表性的國家美國和德國的音樂作品保護現(xiàn)狀,以期能對我國當下的音樂作品保護起到指導借鑒作用。 第四章提出構建我國音樂作品著作權保護體系。先是指出我國在音樂著作權保護方面的不足之處,,然后提出完善我國音樂作品著作權保護的一些建議。
[Abstract]:With the rapid economic development of modern society, while people's wallets are increasingly bulging, spiritual life is also increasingly rich. Entertainment and enjoyment naturally include it. In recent years, the phenomenon of music works of other people has occurred frequently. With the enactment and implementation of the relevant intellectual property law, the awareness of copyright protection of the public has become more and more. The right holders of music works have more "sign" awareness of their works. In the face of violation of their legitimate rights and interests of users more choose to take up the legal weapons. However, with the increasing number of copyright disputes in recent years, Many problems are also exposed in the recognition of tort liability of music works. This paper mainly focuses on the discussion of copyright infringement of music works based on several existing forms. The paper is divided into four chapters to study this problem. The first chapter mainly discusses the definition of the musical works, the popular causes and the types of the captions, clarifies the legal concept of the cover music, points out the main factors of the popularity of the music works, and distinguishes the music works from the others. The second chapter describes the basis for the rational use of music works, mainly to define the copyright infringement, It is clear that the legal liability caused by the copyright infringement. The definition of tort and the legal liability under the respective circumstances are analyzed respectively in several forms. The third chapter mainly analyzes the current situation of the protection of foreign music works, from the legislative level to the copyright association and other operating mechanisms to point out the representative countries of the United States and Germany, the status quo of the protection of music works. With a view to the protection of our current music works play a guiding role. Chapter 4th puts forward the construction of the copyright protection system of music works in China, first pointing out the deficiencies in the protection of music copyright in our country, and then putting forward some suggestions to improve the protection of the copyright of music works in our country.
