自貿(mào)區(qū)知識(shí)產(chǎn)權(quán)保護(hù)的立法創(chuàng)新探索

【摘要】:自貿(mào)區(qū)發(fā)展亟需知識(shí)產(chǎn)權(quán)保護(hù)立法創(chuàng)新,雖然上海自貿(mào)區(qū)進(jìn)行了先期探索,但不論在理論抑或?qū)嵺`上,皆仍存較大研究空間。就后來(lái)的天津等自貿(mào)區(qū)而言,基于綜合考量國(guó)內(nèi)外最新形勢(shì),在知識(shí)產(chǎn)權(quán)保護(hù)立法創(chuàng)新問(wèn)題上,應(yīng)堅(jiān)持三項(xiàng)基本原則,即要有國(guó)際視野、突出實(shí)驗(yàn)性、堅(jiān)持原創(chuàng)性。在知識(shí)產(chǎn)權(quán)保護(hù)立法創(chuàng)新實(shí)踐中,天津等自貿(mào)區(qū)應(yīng)用足先試先行政策優(yōu)勢(shì),積極承擔(dān)"完整"的制度實(shí)驗(yàn)使命,這不但包括針對(duì)知識(shí)產(chǎn)權(quán)法在自貿(mào)區(qū)調(diào)整適用,而且應(yīng)確立體系化的解決方案,即合理借鑒國(guó)際成熟經(jīng)驗(yàn),善用國(guó)內(nèi)法治資源,借自貿(mào)區(qū)經(jīng)驗(yàn)反向檢討現(xiàn)行立法等。同時(shí),尤其針對(duì)知識(shí)產(chǎn)權(quán)法的未來(lái)保護(hù)標(biāo)準(zhǔn)難題,應(yīng)建構(gòu)、試行、檢驗(yàn)前瞻性折衷標(biāo)準(zhǔn),即效力上"高于TRIPS協(xié)議,但低于ACTA協(xié)定"的原則性保護(hù)標(biāo)準(zhǔn)。
[Abstract]:The development of free trade area urgently needs intellectual property protection legislation innovation. Although Shanghai free trade zone has carried on the advance exploration, but both in theory and in practice, there is still considerable research space. As far as Tianjin and other free trade zones are concerned later, On the basis of comprehensive consideration of the latest situation at home and abroad, three basic principles should be adhered to in the legislative innovation of intellectual property protection, namely, to have an international perspective, to highlight experiments, and to adhere to originality. In the practice of legislative innovation in intellectual property rights protection, The FTAs such as Tianjin have the advantage of the policy of "first test first" and actively undertake the "complete" system experiment mission. This includes not only the adjustment and application of intellectual property law in the FTAZ, but also the establishment of a systematic solution. That is, to rationally learn from international mature experience, to make good use of domestic legal resources, and to take advantage of the experience of the Free Trade area to reverse review the existing legislation. At the same time, in view of the difficult problem of the future protection standards of intellectual property law, it is necessary to construct, try out, and test forward-looking compromise standards. In effect, it is higher than TRIPS agreement, but lower than the principle protection standard of ACTA agreement.
