【摘要】：PCB是電子信息產(chǎn)業(yè)的重要組成部分,被廣泛應(yīng)用于電子信息產(chǎn)業(yè)的各個(gè)領(lǐng)域。在研發(fā)設(shè)計(jì)PCB的過程中,PCB布圖設(shè)計(jì)是一個(gè)至關(guān)重要的環(huán)節(jié),這一環(huán)節(jié)需要投入巨大的人力和物力,凝聚著開發(fā)設(shè)計(jì)者的創(chuàng)造性勞動(dòng)。隨著市場(chǎng)競(jìng)爭的日益激烈,針對(duì)PCB的復(fù)制、剽竊行為也不斷滋生,其中PCB反向工程涉及的問題尤為突出。PCB反向工程主要是對(duì)已有的PCB進(jìn)行反向分析和研究從而得到新的PCB布圖設(shè)計(jì),這難免會(huì)對(duì)原PCB布圖設(shè)計(jì)進(jìn)行復(fù)制和模仿,從而引發(fā)知識(shí)產(chǎn)權(quán)糾紛。作為一項(xiàng)智力成果,PCB布圖設(shè)計(jì)應(yīng)該受到相關(guān)知識(shí)產(chǎn)權(quán)法律的保護(hù),但是現(xiàn)有的知識(shí)產(chǎn)權(quán)法律沒有對(duì)PCB布圖設(shè)計(jì)做出明確的規(guī)定,同時(shí)對(duì)PCB反向工程的法律地位也沒有明確,以致PCB反向工程在涉及知識(shí)產(chǎn)權(quán)侵權(quán)問題時(shí),在司法領(lǐng)域無法得到有效的救濟(jì)。為了促進(jìn)PCB產(chǎn)業(yè)的健康發(fā)展和維護(hù)原PCB設(shè)計(jì)者的合法權(quán)益,我們有必要對(duì)PCB反向工程中涉及的侵權(quán)問題進(jìn)行深入研究。 PCB反向工程涉及到的知識(shí)產(chǎn)權(quán)問題主要是復(fù)制侵權(quán)問題,這種復(fù)制不同于著作權(quán)法意義上的復(fù)制,分為完全復(fù)制和部分復(fù)制兩種。在認(rèn)定此種復(fù)制侵權(quán)行為時(shí)沒有現(xiàn)成的標(biāo)準(zhǔn),只能借鑒集成電路布圖設(shè)計(jì)的相關(guān)司法經(jīng)驗(yàn)采取實(shí)質(zhì)性相似的標(biāo)準(zhǔn),從新PCB布圖設(shè)計(jì)和原PCB布圖設(shè)計(jì)的相似程度方面進(jìn)行認(rèn)定。出現(xiàn)上述情況的主要原因在于我國現(xiàn)有的法律在保護(hù)產(chǎn)品層面上的PCB布圖設(shè)計(jì)方面存在不足,并且沒有具體明確PCB反向工程的法律地位及區(qū)分PCB反向工程與復(fù)制侵權(quán)的標(biāo)準(zhǔn)�；赑CB反向工程中涉及的復(fù)制侵權(quán)問題的特殊性,我們提出了兩個(gè)方面的建議,一是推進(jìn)行業(yè)內(nèi)的自律性管理,規(guī)范市場(chǎng)秩序,建立行業(yè)內(nèi)的糾紛調(diào)處機(jī)制,形成良好的知識(shí)產(chǎn)權(quán)氛圍。是完善相關(guān)的立法,在考察了修改現(xiàn)有的法律難以滿足對(duì)PCB的保護(hù)的情況下,探討了單獨(dú)立法的可行性,同時(shí)在借鑒國外關(guān)于反向工程立法的有益經(jīng)驗(yàn)的基礎(chǔ)上,提出了在單獨(dú)立法的框架下必須明確PCB的保護(hù)范圍和確立PCB反向工程的法律地位,完善PCB反向工程的實(shí)施條件的建議。在處理復(fù)制侵權(quán)問題時(shí)采取實(shí)質(zhì)性相同的認(rèn)定標(biāo)準(zhǔn),將屬于公眾熟知的常規(guī)設(shè)計(jì)部分過濾掉,再對(duì)其他核心部分進(jìn)行對(duì)比,從而使侵權(quán)認(rèn)定更加科學(xué)和規(guī)范。
[Abstract]:PCB is an important part of electronic information industry and is widely used in all fields of electronic information industry. As the competition in the market becomes increasingly fierce, plagiarism continues to breed in response to the replication of PCB. The problems involved in reverse engineering of PCB are especially prominent. The reverse engineering of PCB is mainly about reverse analysis and research of existing PCB to obtain a new layout design of PCB, which will inevitably duplicate and imitate the original layout design of PCB. As an intellectual achievement, PCB layout design should be protected by relevant intellectual property law, but the existing intellectual property law does not make clear provisions on PCB layout design. At the same time, the legal status of PCB reverse engineering is not clear, so that PCB reverse engineering involves the infringement of intellectual property rights. In order to promote the healthy development of the PCB industry and protect the legitimate rights and interests of the original PCB designers, it is necessary for us to conduct a thorough study on the infringement problems involved in the reverse engineering of PCB. The intellectual property problem involved in the reverse engineering of PCB is mainly the issue of copy infringement, which is different from the copy in the sense of copyright law and can be divided into two types: complete copy and partial copy. We can only use the relevant judicial experience of integrated circuit layout design for reference and adopt substantially similar standards. From the aspect of similarity between the new PCB layout-design and the original PCB layout-design, the main reason for the above situation is that the existing laws of our country are insufficient in protecting the PCB layout-design at the product level. Moreover, the legal status of PCB reverse engineering and the standard of distinguishing PCB reverse engineering from replication infringement are not specified. Based on the particularity of the replication tort involved in PCB reverse engineering, we put forward two suggestions. First, to promote self-discipline management in the industry, standardize market order, establish a dispute mediation mechanism in the industry, and form a good intellectual property atmosphere. It is to perfect the relevant legislation. On the condition that it is difficult to satisfy the protection of PCB by modifying the existing law, this paper discusses the feasibility of separate legislation, and at the same time, on the basis of drawing lessons from the beneficial experience of foreign countries on reverse engineering legislation, Under the framework of separate legislation, it is necessary to define the scope of PCB protection, establish the legal status of PCB reverse engineering, and perfect the implementation conditions of PCB reverse engineering. Filter out the common design parts that are familiar to the public, and then compare the other core parts to make the tort identification more scientific and standard.
