【摘要】：中國互聯(lián)網(wǎng)已經(jīng)形成規(guī)模，走向多元化，與互聯(lián)網(wǎng)聯(lián)通的終端也開始豐富，從計算機到手機，乃至現(xiàn)在的互聯(lián)網(wǎng)機頂盒，，均改變著我們的生活。通過機頂盒觀看互聯(lián)網(wǎng)上的點播視頻時，著作權(quán)侵權(quán)問題便凸顯了出來。傳統(tǒng)電視機平臺上的節(jié)目會落入“廣播權(quán)”的保護范圍，與基于互聯(lián)網(wǎng)的“信息網(wǎng)絡傳播權(quán)”有何區(qū)別、互聯(lián)網(wǎng)機頂盒生產(chǎn)商的侵權(quán)責任落入哪一范圍、有著怎樣的著作權(quán)問題呢？本文將分析該視頻傳播平臺涉及到的知識產(chǎn)權(quán)法律問題，通過對國內(nèi)外相關法律的研究，確認其所涉權(quán)項的歸責原則和法律適用，為我國今后的立法提出一些可完善之處，為確立一個較規(guī)整的行業(yè)標準打下基礎，為互聯(lián)網(wǎng)機頂盒作品著作權(quán)的保護方式提供一些可行的建議，實現(xiàn)著作權(quán)人與終端生產(chǎn)商的雙贏。 論文分為五章，第一章包括論文研究的背景和意義，國內(nèi)外研究綜述，論文研究的框架與方法；第二章首先介紹了一下三網(wǎng)融合的大背景，增強了課題研究的現(xiàn)實性。其次對互聯(lián)網(wǎng)機頂盒的定義作了說明，提供知識背景。最后簡述了互聯(lián)網(wǎng)機頂盒在國內(nèi)外發(fā)展的狀況；第三章從我國的侵權(quán)責任法的角度，對與互聯(lián)網(wǎng)機頂盒著作權(quán)侵權(quán)問題相關的法條做了一定的分析；第四章借助國外的相關理論對互聯(lián)網(wǎng)機頂盒著作權(quán)侵權(quán)問題進行分析，包括美國的間接侵權(quán)理論、索尼規(guī)則，以及歐盟電子商務指令一些條款對我國立法的借鑒作用；第五章得出結(jié)論，并從幾個宏觀與微觀的角度對互聯(lián)網(wǎng)機頂盒產(chǎn)業(yè)的發(fā)展提出建議，包括法律法規(guī)及行業(yè)標準的完善、知識產(chǎn)權(quán)意識的提高以及互聯(lián)網(wǎng)機頂盒運營模式。
[Abstract]:The Chinese Internet has formed the scale, moving towards the diversification, the terminal that connects with the Internet also begins to enrich, from the computer to the mobile phone, even now the Internet set-top box. When watching on-demand video on the Internet through set-top box, copyright infringement is highlighted. Programs on traditional television platform will fall into the scope of "broadcast right" protection. What is the difference between the Internet and the Internet based on "the right to spread information network"? what is the scope of the tort liability of the Internet set-top box manufacturer, and what kind of copyright problem does it have? This paper will analyze the intellectual property legal issues involved in the video dissemination platform, and confirm the principle of imputation and legal application of the related rights through the study of the relevant laws at home and abroad. For the future legislation of our country to put forward some perfect, for the establishment of a more regular industry standards to lay the foundation for the Internet set-top box works copyright protection mode to provide some feasible suggestions. Realize the double-win between copyright owner and terminal manufacturer. The paper is divided into five chapters. The first chapter includes the background and significance of the research, the domestic and foreign research review, the research framework and methods; The second chapter introduces the background of the integration of three networks, enhances the reality of the research. Secondly, the definition of the Internet set-top box is explained. Finally, the development of Internet STB at home and abroad is briefly described. The third chapter from our country's tort liability law angle, has made the certain analysis to the Internet set-top box copyright infringement question related law; Chapter 4th analyzes the infringement of Internet set-top box copyright with the help of foreign theories, including the indirect infringement theory of the United States, Sony rules. As well as some provisions of the European Union E-commerce Directive for reference to our legislation; Chapter 5th draws a conclusion, and from several macro and micro angles to the development of Internet set-top box industry, including the improvement of laws and regulations and industry standards. The improvement of intellectual property consciousness and the operation mode of Internet set-top box.
