【摘要】：近年來,以創(chuàng)意為基礎(chǔ)形成的文化創(chuàng)意產(chǎn)業(yè),已經(jīng)成為拉動河南省經(jīng)濟增長和提升自主創(chuàng)新能力的新興經(jīng)濟模式。文化創(chuàng)意產(chǎn)業(yè)受到河南省相關(guān)部門的極大關(guān)注。創(chuàng)新能力是文化創(chuàng)意產(chǎn)業(yè)的基礎(chǔ),該產(chǎn)業(yè)融合了文化與科技、文明與智慧,同時文化創(chuàng)意產(chǎn)業(yè)依托知識產(chǎn)權(quán)保護(hù)而進(jìn)一步發(fā)展壯大。知識產(chǎn)權(quán)保護(hù)是文化創(chuàng)意產(chǎn)業(yè)產(chǎn)生和存在的基石。河南省將文化創(chuàng)意產(chǎn)業(yè)作為戰(zhàn)略新興產(chǎn)業(yè),并采取了許多積極的有效的措施,保護(hù)文化創(chuàng)意產(chǎn)業(yè)持續(xù)健康發(fā)展。然而,該產(chǎn)業(yè)在河南省尚處于發(fā)展階段,并且由于文化創(chuàng)意產(chǎn)業(yè)自身的特殊性,知識產(chǎn)權(quán)保護(hù)在河南省的立法、執(zhí)法、司法等方面存在諸多缺陷。目前河南省文化創(chuàng)意產(chǎn)業(yè)的保護(hù)不完全、不充分,導(dǎo)致出現(xiàn)這一問題的根本原因在于河南省以及我國現(xiàn)行法律沒有對文化創(chuàng)意所涉及的各種利益進(jìn)行的調(diào)整和平衡。在文化創(chuàng)意飛速發(fā)展的今天,河南省面對文化創(chuàng)意產(chǎn)業(yè)的相關(guān)新想法、新思想屢屢被抄襲,文化創(chuàng)意人的相關(guān)權(quán)益不斷被侵害、社會持續(xù)健康發(fā)展面臨著巨大的挑戰(zhàn),論文提出河南省在文化創(chuàng)意產(chǎn)業(yè)知識產(chǎn)權(quán)保護(hù)專項立法缺失、權(quán)利保護(hù)不充分、文化創(chuàng)意企業(yè)知識產(chǎn)權(quán)保護(hù)法律意識不強、執(zhí)法部門眾多執(zhí)法力度不夠、忽視司法程序與監(jiān)督缺失、法律制度相對落后、權(quán)利保護(hù)與信息共享沖突、侵權(quán)糾紛泛濫等諸多問題。最后本文根據(jù)文化創(chuàng)意產(chǎn)業(yè)本身的特點,結(jié)合河南省傳統(tǒng)知識產(chǎn)權(quán)相關(guān)制度,以及為了彌補河南省文化創(chuàng)意產(chǎn)業(yè)知識產(chǎn)權(quán)保護(hù)中存在的不足,河南省需要建立一個完善的、多層次的知識產(chǎn)權(quán)保護(hù)體系。需要在完善知識產(chǎn)權(quán)保護(hù)的立法體系、增強文化創(chuàng)意產(chǎn)業(yè)知識產(chǎn)權(quán)保護(hù)的法律意識、進(jìn)一步理順執(zhí)法體制、改革知識產(chǎn)權(quán)審判管轄體制和工作機制、建立統(tǒng)一的知識產(chǎn)權(quán)公共服務(wù)平臺等方面予以改善。
[Abstract]:In recent years, cultural and creative industries based on creativity have been formed. Cultural and creative industries have attracted great attention from relevant departments in Henan Province. Innovation ability is the foundation of cultural and creative industries. The industry combines culture and technology, civilization and wisdom. At the same time, cultural and creative industries rely on the protection of intellectual property rights to further develop. Intellectual property protection is the cornerstone of the emergence and existence of cultural and creative industries. Henan Province takes cultural and creative industries as a strategic emerging industry. And has taken many positive and effective measures to protect the sustainable and healthy development of cultural and creative industries. However, the industry in Henan Province is still in the development stage, and because of the particularity of cultural and creative industries. The protection of intellectual property rights in Henan Province legislation, law enforcement, judicial and other aspects of many defects. At present, the protection of cultural and creative industries in Henan Province is not complete, inadequate. The root cause of this problem lies in the fact that Henan Province and the current laws of our country have not adjusted and balanced all kinds of interests involved in cultural creativity. Henan Province faces the cultural creative industry related new ideas, new ideas are plagiarized, cultural and creative people's rights and interests continue to be infringed, the sustainable and healthy development of society is facing a huge challenge. The paper points out that Henan Province in the cultural and creative industries intellectual property rights protection special legislation is missing, rights protection is not sufficient, cultural and creative enterprises intellectual property protection legal awareness is not strong, law enforcement departments are not enough to enforce the law. Ignore the lack of judicial procedures and supervision, the legal system is relatively backward, rights protection and information sharing conflicts, infringement disputes and many other issues. Finally, according to the characteristics of cultural and creative industries. Combined with the traditional system of intellectual property rights in Henan Province, and in order to make up for the shortcomings in the protection of intellectual property rights of cultural and creative industries in Henan Province, Henan Province needs to establish a perfect. Multi-level intellectual property protection system. It is necessary to perfect the legislative system of intellectual property protection, strengthen the legal awareness of intellectual property protection of cultural and creative industries, and further straighten out the law enforcement system. Reform the intellectual property jurisdiction system and working mechanism, establish a unified intellectual property public service platform and other aspects to improve.
