基于世界衛(wèi)生組織精神衛(wèi)生立法檢查清單的中國與印度尼西亞精神衛(wèi)生法比較研究

近年來精神障礙和社會心理問題的患病率顯著增加。精神障礙患者是最脆弱的人群之一,他們的政治、經(jīng)濟、社會和文化權利經(jīng)常被忽視,在利用衛(wèi)生保健、保險、就業(yè)和住房方面也受到歧視。精神衛(wèi)生立法可以提高精神障礙患者的生活水平,可以為保護精神障礙患者的基本人權提供保障,還可以為精神障礙患者的社區(qū)融合,改善其獲得衛(wèi)生保健的機會,保護公民權利,以及住房、教育和就業(yè)等關鍵問題的解決提供法律框架。精神衛(wèi)生法成為促進精神障礙患者獲得精神保健服務,促進和保護其權利的有效工具。事實上,精神衛(wèi)生系統(tǒng)的建立是一個循序漸進的過程,盡管一些國家已經(jīng)建立了精神衛(wèi)生法,但是其精神衛(wèi)生體系仍然需要進一步完善。國家需要對精神衛(wèi)生立法不斷進行審查、修訂和修正,不斷提高其質(zhì)量。世界衛(wèi)生組織于2005年發(fā)布了一份關于精神衛(wèi)生立法的檢查清單,目的是為各國制定以人權為中心的精神衛(wèi)生法提供指導。這份清單不是一套絕對的規(guī)則,它有助于各國評估其精神衛(wèi)生立法是否已包括了關鍵組成部分,也有助于拉近各國精神衛(wèi)生立法與《世界人權宣言》之間的聯(lián)系。目的精神衛(wèi)生立法的目的是保護、促進和改善公民的生活和精神健康。制定精神衛(wèi)生法可以成為保護和促進人們獲得利用精...
