【摘要】：在美國,35個州和哥倫比亞特區(qū)通過了各自的道歉法,澳大利亞的全部6個州和2個領地也均已制定了道歉法。首先概述域外道歉法的制度起源和發(fā)展現(xiàn)狀,著重關注其在醫(yī)療糾紛解決領域中的快速進展。其次,分析道歉法在醫(yī)療糾紛解決領域中快速發(fā)展的契合條件,即所突顯的四大特有功能。最后,評析我國醫(yī)療糾紛解決領域中的強制賠禮道歉制度與域外道歉法的異同,澄清道歉法在我國醫(yī)療糾紛解決中的認識誤區(qū),并結合強制賠禮道歉作為我國法律中的特有現(xiàn)象這一立法傳統(tǒng),提出其在基本醫(yī)療衛(wèi)生法上的立法構想。
[Abstract]:In the United States, 35 states and the District of Columbia have passed their own apology laws, and all six states and two territories in Australia have enacted apology laws. Firstly, the system origin and development status of foreign apology law are summarized, with emphasis on its rapid progress in the field of medical dispute resolution. Secondly, it analyzes the suitable conditions for the rapid development of apology law in the field of medical dispute resolution, that is, the four unique functions highlighted. Finally, this paper analyzes the similarities and differences between the compulsory apology system and the foreign apology law in the field of medical dispute resolution in our country, clarifies the misunderstanding of the apology law in the resolution of medical disputes in our country, and puts forward its legislative conception in the basic medical and health law in the light of the legislative tradition of compulsory apology as a unique phenomenon in the law of our country.
