【摘要】：在"三權(quán)分置"的法律架構(gòu)中,"土地經(jīng)營權(quán)"與土地承包權(quán)的分離屬承包土地的"債權(quán)型利用",但應(yīng)賦予分置后的"土地經(jīng)營權(quán)"一定的支配和排他效力以利其流轉(zhuǎn)。"三權(quán)分置"的法制完善應(yīng)從落實集體土地所有權(quán)、穩(wěn)定土地承包權(quán)、放活土地經(jīng)營權(quán)等方面著手,明確集體土地成員權(quán)內(nèi)容,完善土地承包權(quán)設(shè)立與存續(xù)規(guī)則,凸顯土地經(jīng)營權(quán)的財產(chǎn)性質(zhì),確立土地經(jīng)營權(quán)流轉(zhuǎn)方式及其配套制度。
[Abstract]:In the legal framework of "the separation of the three rights", the separation of the "land management right" and the land contract right belongs to the "debt-type utilization" of the contracted land, but it should be given certain dominance and exclusive effect of the "land management right" after the separation in order to facilitate its circulation. " The perfection of the legal system of "the separation of the three rights" should begin with the implementation of collective land ownership, the stabilization of land contract rights, the release of land management rights, the clarification of the content of collective land members' rights, and the perfection of the rules for the establishment and survival of land contract rights. Highlight the property nature of land management right, establish the transfer mode of land management right and its supporting system.
