論食品安全領(lǐng)域消費者權(quán)益保護

【摘要】:食品安全是民眾生活最基本的保障,若食品安全存在巨大隱患,則會危及民眾健康甚至使人民處于失去生命的危險境地,對于社會穩(wěn)定以及和諧社會的建設(shè)將是極大的障礙。通過分析人類發(fā)展歷程能夠發(fā)現(xiàn),溫飽問題解決后,實現(xiàn)小康成為民眾普遍的目標,物質(zhì)水平的提升使得人們更加注重健康。如今社會分工趨于細致化,人們?nèi)粘I钏枰氖称反蠖嘤蓪iT的生產(chǎn)企業(yè)提供,關(guān)于食品安全也成為人們關(guān)注的焦點。近些年,有關(guān)食品安全的惡性事件不斷涌現(xiàn),如美贊臣乳制品中金屬超標以及乳制品行業(yè)普遍存在的三聚氰胺事件;還有肉制品行業(yè)廣泛存在的“瘦肉精”、“注水肉”事件;水產(chǎn)品行業(yè)中普遍將“洗蝦粉”、“孔雀石綠”等化工原料注入水產(chǎn)品中,讓水產(chǎn)品看起來更明亮、新鮮;農(nóng)產(chǎn)品中大量的農(nóng)藥殘留等等一些列食品安全相關(guān)的問題事件充斥著人們的生活。在這種背景下,本文以食品安全為題展開關(guān)于消費者權(quán)益保護的探討,希望為消費者面臨食品安全問題時維護自身權(quán)益提供參考。本文結(jié)構(gòu)主要包含如下幾個部分:首先是引言,對選題背景與研究意義進行了概述,同時對各個國家關(guān)于食品安全消費者維權(quán)的國內(nèi)外研究狀況進行了總結(jié)概括。第一章,選擇近些年曝光的影響力較大的食品安全事件為研究案例,并對這些案例進行深入分析,發(fā)現(xiàn)其中存在的問題。第二章,結(jié)合以上闡述,分析了現(xiàn)階段我國食品安全領(lǐng)域內(nèi)消費者權(quán)益保護中存在的不足;第三章,對美國、日本等一些發(fā)達國家中為充分保障食品安全,在立法、監(jiān)管等方面采取的措施,并與中國實際狀況相結(jié)合,探尋我國加強食品安全、充分保障消費者權(quán)益的優(yōu)化策略。第四章,結(jié)合以上描述以及分析結(jié)論,提出了我國食品安全工作中在立法、監(jiān)管等方面的一些優(yōu)化策略,以充分保障食品安全,切實維護消費者利益。
[Abstract]:Food safety is the most basic guarantee of people's lives. If there are huge hidden dangers in food safety, it will endanger the people's health and even make the people lose their lives. It will be a great obstacle to the social stability and the construction of a harmonious society. Through analyzing the course of human development, it can be found that after solving the problem of food and clothing, achieving a well-off society becomes a universal goal of the people, and the improvement of material level makes people pay more attention to health. Nowadays, the social division of labor tends to be meticulous, most of the food needed by people's daily life is provided by specialized production enterprises, and food safety has also become the focus of people's attention. In recent years, malignant incidents about food safety have emerged constantly, such as the metal exceeding standard in American dairy products and melamine in dairy products industry, and the "lean meat essence" and "water injection meat" incidents in meat products industry, which are widely existed in meat products industry, such as "lean meat essence", "water injection meat", and so on. Aquatic products industry will generally "wash shrimp powder", "malachite green" and other chemical raw materials into aquatic products, so that aquatic products look brighter, fresh; Agricultural products, such as a large number of pesticide residues and other food safety-related issues are full of people's lives. Under this background, this paper discusses the protection of consumers' rights and interests on the topic of food safety, hoping to provide a reference for consumers to safeguard their rights and interests when facing food safety problems. The structure of this paper mainly consists of the following parts: firstly, the background and significance of the topic selection are summarized, and the domestic and foreign research status of food safety consumers' rights protection are summarized. In the first chapter, we choose the influential food safety events exposed in recent years as the research cases, and analyze these cases in depth, and find out the existing problems. The second chapter, combined with the above elaboration, analyzes the shortcomings in the protection of consumers' rights and interests in the field of food safety in China at the present stage; In the third chapter, in order to fully protect food safety in some developed countries, such as the United States and Japan, the measures taken in legislation, supervision and other aspects, and in combination with the actual situation in China, to explore the strengthening of food safety in China, Full protection of consumer rights and interests of the optimization strategy. In the fourth chapter, combined with the above description and analysis conclusions, some optimization strategies in legislation, supervision and other aspects of food safety work in our country are put forward in order to fully protect food safety and protect consumers' interests.
