【摘要】：中共中央提出綠色發(fā)展新理念,"十三五"期間以提高環(huán)境質(zhì)量為核心,改革環(huán)境治理基礎(chǔ)制度,實(shí)行省以下環(huán)保監(jiān)測(cè)監(jiān)察執(zhí)法垂直管理制度,這是我國(guó)環(huán)境保護(hù)工作體制的重大變革,對(duì)推進(jìn)生態(tài)文明建設(shè)意義深遠(yuǎn)。本文從檢視我國(guó)現(xiàn)行環(huán)境執(zhí)法的體制局限入手,對(duì)環(huán)保部門(mén)"統(tǒng)一監(jiān)督管理"的法定職責(zé)進(jìn)行分析,提出了"統(tǒng)一管理權(quán)"與"統(tǒng)一監(jiān)督權(quán)"分立的主張,并對(duì)垂直管理體制的利弊作了較為深入的分析。
[Abstract]:The CPC Central Committee has put forward a new concept of green development. During the 13th five-year Plan period, we will take improving environmental quality as the core, reform the basic system of environmental governance, and implement a vertical management system for environmental protection monitoring, supervision and enforcement under the provincial level. This is a major change in the system of environmental protection in China, and has far-reaching significance in promoting the construction of ecological civilization. Starting with examining the limitation of the current environmental law enforcement system in our country, this paper analyzes the legal duties of the environmental protection department "unified supervision and management", and puts forward the idea of the separation of "unified management power" and "unified supervision power". The advantages and disadvantages of vertical management system are analyzed deeply.
