【摘要】：生態(tài)文明入憲是健全中國(guó)特色社會(huì)主義法律體系、為生態(tài)文明建設(shè)提供根本法依據(jù)的內(nèi)在要求。由于生態(tài)文明已經(jīng)入黨章,因此入憲是黨內(nèi)法規(guī)和國(guó)家立法全面銜接和協(xié)調(diào)的要求。關(guān)于入憲的思路和方法,可以采取理論闡述與原則規(guī)定相結(jié)合的方法,內(nèi)容體現(xiàn)黨章的要求,表述符合憲法的風(fēng)格,并梳理現(xiàn)有政策和法律的規(guī)定,提煉出生態(tài)文明建設(shè)的系統(tǒng)性和根本性規(guī)定。在此基礎(chǔ)上,本文分別對(duì)憲法的"序言"和"總綱"的內(nèi)容做出補(bǔ)充和修改。
[Abstract]:The entry of ecological civilization into the constitution is the inherent requirement of perfecting the legal system of socialism with Chinese characteristics and providing the basis for the construction of ecological civilization. Since ecological civilization has entered the Party Constitution, it is the requirement of overall connection and coordination between laws and regulations within the Party and national legislation. With regard to the ideas and methods of entering the Constitution, we can adopt the method of combining theoretical elaboration with the provisions of principles, the content of which reflects the requirements of the Party Constitution, the style of expression in line with the Constitution, and combs the existing policies and provisions of the law. Abstract the systematic and fundamental provisions of ecological civilization construction. On this basis, this paper supplements and modifies the contents of the preamble and the general outline of the Constitution.
