【摘要】：隨著我國經(jīng)濟(jì)社會的進(jìn)步，特別是農(nóng)副業(yè)的穩(wěn)步增產(chǎn)和食品工業(yè)的高速發(fā)展，人民群眾對食品的態(tài)度，已從解決溫飽轉(zhuǎn)變?yōu)樽非筚|(zhì)量和健康，食品安全問題由此誕生并隨著近年食品安全事件的不斷“發(fā)酵”而愈演愈烈。我國作為以人民根本利益為出發(fā)點(diǎn)的社會主義法治政府，保障食品安全責(zé)無旁貸，而行政執(zhí)法作為政府監(jiān)管措施的強(qiáng)制力保障則扮演著重要角色，其是以強(qiáng)制力為后盾，把法律從應(yīng)然轉(zhuǎn)變?yōu)閷?shí)然的一個過程。因此，加強(qiáng)食品安全的行政執(zhí)法是我國的食品安全法治建設(shè)過程的重要一環(huán)。 在食品安全的各個環(huán)節(jié)中，，生產(chǎn)環(huán)節(jié)上承初級農(nóng)產(chǎn)品加工，下啟食品流通銷售，其重要性不言而喻；只要在食品生產(chǎn)環(huán)節(jié)中做到對上游初級農(nóng)產(chǎn)品把好原材料品質(zhì)關(guān)，生產(chǎn)把好質(zhì)量控制關(guān)，進(jìn)入流通領(lǐng)域的自然而然便是能使人民群眾放心食用的安全食品。因此，食品生產(chǎn)安全是食品安全關(guān)鍵點(diǎn)，文章結(jié)合食品監(jiān)督管理部門在食品生產(chǎn)環(huán)節(jié)的行政執(zhí)法實(shí)踐，從以下幾個方面對食品生產(chǎn)安全行政執(zhí)法進(jìn)行研究論述： 第一部分為緒論部分，主要論述了本研究的選題背景、選題意義、國內(nèi)外研究現(xiàn)狀、研究目標(biāo)、研究思路以及具體的研究方法；第二部分為相關(guān)概念和理論部分，主要論述了食品、食品安全、行政執(zhí)法等概念，以及我國食品安全的行政執(zhí)法框架、食品安全生產(chǎn)環(huán)節(jié)的行政執(zhí)法、相關(guān)理論；第三部分為清遠(yuǎn)市食品生產(chǎn)安全行政執(zhí)法現(xiàn)狀，主要論述了清遠(yuǎn)市食品生產(chǎn)安全行政執(zhí)法中取得的成績以及存在的問題，并對存在問題的原因進(jìn)行分析；第四部分為國內(nèi)外食品生產(chǎn)安全行政執(zhí)法及其經(jīng)驗借鑒部分，主要論述了美國、日本等國外食品生產(chǎn)安全行政執(zhí)法的先進(jìn)經(jīng)驗以及香港、臺灣等國內(nèi)食品生產(chǎn)安全行政執(zhí)法的先進(jìn)經(jīng)驗，并對這些先進(jìn)行政執(zhí)法經(jīng)驗進(jìn)行借鑒；第五部分為完善清遠(yuǎn)市食品生產(chǎn)安全行政執(zhí)法的對策措施部分，主要結(jié)合清遠(yuǎn)市食品生產(chǎn)安全行政執(zhí)法中存在的問題提出針對性的解決對策，從而提高清遠(yuǎn)市食品生產(chǎn)安全行政執(zhí)法水平。
[Abstract]:With the progress of our country's economy and society, especially the steady increase in agricultural production and the rapid development of the food industry, the people's attitude towards food has changed from solving the problem of food and clothing to pursuing quality and health. The problem of food safety was born and intensified with the development of food safety events in recent years. As a socialist government under the rule of law with the fundamental interests of the people as the starting point, our country is duty-bound to ensure food safety, while administrative law enforcement plays an important role as the compulsory force guarantee of the government's supervisory measures, and it is backed by the coercive force. The process of transforming the law from what it ought to be to what it should be. Therefore, strengthening the administrative law enforcement of food safety is an important part of the construction of food safety rule of law in our country. In each link of food safety, the importance of the production link is self-evident. As long as the quality of raw materials and the quality control of raw materials are controlled in the food production link, the safe food which can make the people comfortable to eat is the natural way to enter the circulation field. Therefore, food production safety is the key point of food safety. From the following aspects of food production safety administrative law enforcement research: the first part is the introduction, mainly discusses the background of this study, the significance of the topic, domestic and foreign research status, research objectives, Research ideas and specific research methods; The second part is related to the concept and theory, mainly discusses the food, food safety, administrative law enforcement and other concepts, as well as China's food safety administrative law enforcement framework, food safety production link of administrative law enforcement, related theories; The third part is the current situation of food production safety administrative law enforcement in Qingyuan City, mainly discusses the achievements and problems in Qingyuan City food production safety administrative law enforcement, and analyzes the reasons for the problems. The fourth part is the domestic and foreign food production safety administrative law enforcement and the experience reference part, mainly elaborated the United States, Japan and so on foreign food production safety administration law enforcement advanced experience as well as Hong Kong, Taiwan and other domestic food production safety administrative law enforcement advanced experience, and these advanced administrative law enforcement experience for reference; The fifth part is the countermeasures and measures to perfect the administrative law enforcement of food production safety in Qingyuan City, mainly combining with the problems existing in the administrative law enforcement of food production safety in Qingyuan City.
