外籍教師管理的法律研究

【摘要】:在教育國際化的新時(shí)期,,外籍教師已經(jīng)成為高校教育體系中不可或缺的重要組成部分。高等教育是培養(yǎng)人才的前沿陣地,為了適應(yīng)時(shí)代的發(fā)展需要,國內(nèi)許多高校已將提高國際化進(jìn)程作為學(xué)校發(fā)展的一項(xiàng)重要的戰(zhàn)略目標(biāo),大力引進(jìn)國外先進(jìn)的技術(shù)、高水平的專家和教師己成為各高校提升學(xué)校綜合國力的重要手段和綜合實(shí)力的體現(xiàn)。外籍教師作為外國人在華就業(yè)的特殊群體,受到全社會(huì)的關(guān)注,其法律和社會(huì)地位也不斷上升,從最初簡(jiǎn)單的規(guī)章規(guī)則到文教專家的法律保護(hù),這一進(jìn)步彰顯出外籍教師在國際法中法律地位的進(jìn)步及其發(fā)展趨勢(shì)。 我國從19世紀(jì)中期開始引進(jìn)外籍教師,經(jīng)過社會(huì)的不斷進(jìn)步和改革開放的發(fā)展,外籍教師的足跡不僅在時(shí)間上、空間上都有了相當(dāng)程度的拓展。雖然目前我國外籍教師的管理工作已經(jīng)不斷地規(guī)范化,但是仍然缺少法律保護(hù),外籍教師的權(quán)利與義務(wù)也缺少必要的法律支持,外籍教師管理過程中仍然存在問題需要得到我們的重視并及時(shí)解決,因而外籍教師的管理成為一項(xiàng)十分艱巨而且政策性很強(qiáng)的工作。 作者回顧整理了大量國內(nèi)相關(guān)論著、文獻(xiàn),在對(duì)留學(xué)生院外籍教師管理處的工作人員進(jìn)行了調(diào)研的基礎(chǔ)上,概述了目前高校外籍教師管理的相關(guān)法律制度,并借鑒外籍教師管理的國際法依據(jù),對(duì)比我國外籍教師管理的規(guī)章制度,分析了外籍教師管理現(xiàn)狀和相關(guān)法律制度建設(shè)狀況,揭示了外籍教師管理中存在的聘請(qǐng)制度不健全、薪酬制度不具體、績效管理制度缺乏和合同制度的不完善等問題,淺析了外籍教師管理法律制度執(zhí)行力度不強(qiáng)的原因。研究針對(duì)如何改善外籍教師管理制度提出了完善外事法規(guī)在制定、盡快制定《中華人民共和國外籍教師管理法》、形成完整的涉外法律體系、進(jìn)一步深化行政體制改革和政府職能轉(zhuǎn)變以及完善相關(guān)制度的建設(shè)等具體的完善意見和立法思路,對(duì)國家在這方面相關(guān)理論研討和政策制定過程具有指導(dǎo)意義。 論文主要分為五個(gè)部分。第一章對(duì)研究背景、研究意義、研究思路、研究方法、創(chuàng)新之處作以簡(jiǎn)要的概述。第二章論述了外籍教師管理的基本概念和理論,以外籍教師管理的兩種定位為切入點(diǎn),通過對(duì)比外籍教師管理的國際法依據(jù)和國內(nèi)一般法律制度,分析了外籍教師管理的相關(guān)法律制度。第三章對(duì)外籍教師的現(xiàn)狀進(jìn)行了介紹,包括外籍教師管理的基本法律及相關(guān)的規(guī)章制度,同時(shí)針對(duì)近些年來外籍教師管理出現(xiàn)的問題進(jìn)行了剖析。第四章主要就影響我國外籍教師管理水平這一問題提出了原因分析,追究其源,為外籍教師管理做理論鋪墊。第五章針對(duì)如何完善我國外籍教師管理制度,提出了相關(guān)法律對(duì)策與建議,為以后確立制度準(zhǔn)則提供參考,這一部分主要從外事政策、外事管理機(jī)構(gòu)以及具體的制度建設(shè)上提出了相關(guān)的法律建議。
[Abstract]:In the new era of internationalization of education, foreign teachers have become an indispensable part of the education system in colleges and universities. Higher education is the front position of cultivating talents. In order to meet the needs of the development of the times, many colleges and universities in China have taken the process of internationalization as an important strategic goal for the development of their schools and vigorously introduced advanced technology from abroad. High-level experts and teachers have become an important means and embodiment of comprehensive strength of colleges and universities. As a special group of foreigners who are employed in China, foreign teachers are concerned by the whole society, and their legal and social status is constantly rising, from the initial simple rules and regulations to the legal protection of cultural and educational experts. This progress highlights the progress and development trend of foreign teachers' legal status in international law. Foreign teachers have been introduced into China since the middle of the 19th century. With the continuous progress of society and the development of reform and opening up, the footprint of foreign teachers has been expanded to a considerable extent not only in time but also in space. Although the management of foreign teachers in our country has been standardized, there is still a lack of legal protection, and the rights and obligations of foreign teachers lack the necessary legal support. In the process of foreign teachers' management, we still need to pay attention to the problems and solve them in time. Therefore, the management of foreign teachers has become a very difficult and policy-oriented task. The author reviews a large number of domestic related works, literature, on the basis of the investigation of the staff of the Foreign teacher Management Office of the Foreign students College, summarizes the relevant legal system of the management of foreign teachers in colleges and universities at present. By comparing the rules and regulations of foreign teachers' management, this paper analyzes the present situation of foreign teachers' management and the construction of relevant legal system, and reveals that the employment system of foreign teachers' management is not perfect. This paper analyzes the reasons for the weak enforcement of the foreign teachers' management law system, such as the lack of the compensation system, the lack of the performance management system and the imperfection of the contract system. In view of how to improve the management system of foreign teachers, the paper puts forward some suggestions on how to perfect the foreign affairs laws and regulations, formulate the Foreign teacher Management Law of the people's Republic of China as soon as possible, and form a complete foreign legal system. Further deepening the reform of the administrative system and the transformation of government functions, as well as perfecting the construction of related systems, and other specific suggestions and legislative ideas, will be of guiding significance for the relevant theoretical research and policy formulation process in this respect. The paper is divided into five parts. The first chapter gives a brief overview of the research background, research significance, research ideas, research methods and innovations. The second chapter discusses the basic concept and theory of foreign teacher management, taking the two kinds of foreign teacher management as the breakthrough point, by comparing the international law basis of foreign teacher management and the domestic general legal system. The related legal system of foreign teachers' management is analyzed. The third chapter introduces the current situation of foreign teachers, including the basic law of foreign teachers management and related rules and regulations, and analyzes the problems in the management of foreign teachers in recent years. The fourth chapter mainly puts forward the reason analysis on the problem of affecting the management level of foreign teachers in our country, investigates its source, and paves the way for the management of foreign teachers. The fifth chapter is about how to perfect the management system of foreign teachers in our country, put forward the relevant legal countermeasures and suggestions, and provide reference for the establishment of the system standards in the future, this part mainly from the foreign affairs policy, The foreign affairs management organization and the concrete system construction put forward the related legal suggestion.
