【摘要】：新《中華人民共和國出境入境管理法》于2012年6月30日由全國人大常委會第27次會議審議并通過。從此之后,我國出入境管理制度在經歷了數(shù)十年發(fā)展的風風雨雨,不斷進步不斷完善,終于迎來了新的開始,自此,新的出入境管理法更加注重維護我國的主權與安全,更加注重出入境人員的合法權益的保障,也因此發(fā)揮了更大的作用。然而我們能看到它在不斷發(fā)展的同時,仍然存在著很多問題,例如其對于維護國家主權的限度問題,對于發(fā)展市場經濟的阻礙問題,對于促進對外開放的限制問題等等。新出臺的《中華人民共和國出境入境管理法》將我國舊的與外國人入出境和中國公民出入境管理相關的法律以及相關的細則整合,對于我國的國籍管理有很大推動作用,并且對于“三非”外國人的管理有很大積極影響。新法是我國出入境管理體制的創(chuàng)新發(fā)展、其對完善出入境管理制度和機制發(fā)揮了積極的指導作用,開啟了出入境執(zhí)法工作的新篇章,先進的執(zhí)法理念、完善的執(zhí)法制度、專業(yè)的執(zhí)法主體將確保出入境執(zhí)法工作取得最佳的社會效果和法律效果。但在健全完善出入境管理法律法規(guī),加大對“三非”外國人的處罰力度,強化完善程序立法,給予外國人充分法律救濟,建立完善外國人管理運行體制等方面似還有待進一步加強。
[Abstract]:The new Law on the Control of exit and entry of the people's Republic of China was deliberated and passed by the 27th meeting of the standing Committee of the National people's Congress on June 30, 2012. Since then, China's immigration and entry management system has experienced decades of development, continued to improve, and finally ushered in a new beginning. Since then, the new immigration management law has paid more attention to safeguarding China's sovereignty and security. Pay more attention to the protection of the legitimate rights and interests of entry-exit personnel, and thus play a greater role. However, we can see that at the same time, there are still many problems, such as the limit of safeguarding national sovereignty, the hindrance to the development of market economy, the restriction of promoting opening to the outside world and so on. The newly promulgated Law on the Control of exit and entry of the people's Republic of China integrates the old laws relating to the entry and exit of foreigners and the entry and exit control of Chinese citizens, as well as the relevant rules and regulations, which has greatly promoted the administration of nationality in China. And for the "three Africa" foreigners management has a great positive impact. The new law is an innovative development of our country's entry and exit management system, which has played a positive guiding role in perfecting the entry and exit management system and mechanism, opened a new chapter in the work of entry and exit law enforcement, advanced law enforcement concepts, and improved the law enforcement system. Professional law enforcement bodies will ensure the best social and legal effects of immigration enforcement. However, in order to improve the laws and regulations governing the entry and exit administration, to increase the punishment of the "three non-foreigners", to strengthen and perfect the procedural legislation, and to give the foreigners adequate legal relief, It'seems that the establishment and perfection of the management and operation system of foreigners still needs to be further strengthened.
