【摘要】：生態(tài)補(bǔ)償是20世紀(jì)50年代以來(lái),一些國(guó)家和地區(qū)為了應(yīng)對(duì)經(jīng)濟(jì)社會(huì)發(fā)展中存在的資源耗竭和生態(tài)破壞問(wèn)題所嘗試采用的一種解決手段。作為生態(tài)維護(hù)與建設(shè)的重要手段,生態(tài)補(bǔ)償在平衡和協(xié)調(diào)經(jīng)濟(jì)社會(huì)發(fā)展與生態(tài)保護(hù)之間的緊張關(guān)系中發(fā)揮著積極而重要的作用。不同學(xué)科領(lǐng)域的學(xué)者對(duì)生態(tài)補(bǔ)償進(jìn)行了不同角度的研究,生態(tài)補(bǔ)償已經(jīng)成為生態(tài)學(xué)、環(huán)境經(jīng)濟(jì)學(xué)、環(huán)境管理學(xué)以及可持續(xù)發(fā)展領(lǐng)域研究的熱點(diǎn)問(wèn)題。 目前,我國(guó)生態(tài)環(huán)境問(wèn)題非常嚴(yán)峻,生態(tài)補(bǔ)償作為生態(tài)維護(hù)和建設(shè)的一種手段越來(lái)越受到人們的重視。但是我國(guó)尚未制定生態(tài)補(bǔ)償?shù)幕痉?生態(tài)補(bǔ)償規(guī)則零散分布于數(shù)量眾多的有關(guān)環(huán)境和資源保護(hù)的單行法律文件,尤其是地方性立法文件中。生態(tài)補(bǔ)償法律制度建設(shè)的滯后,給我國(guó)的生態(tài)補(bǔ)償實(shí)踐帶來(lái)了較為嚴(yán)重的影響�；诖�,本文擬從法學(xué)的視角出發(fā),對(duì)生態(tài)補(bǔ)償法律中的相關(guān)問(wèn)題做一研究,以期對(duì)我國(guó)的生態(tài)補(bǔ)償法律制度建設(shè)有所裨益。 在結(jié)構(gòu)上,本論文由緒論和主體部分構(gòu)成。緒論部分主要介紹了本文的研究意義、研究方法、研究?jī)?nèi)容,并對(duì)國(guó)內(nèi)外文獻(xiàn)資料進(jìn)行了簡(jiǎn)要的評(píng)述。主體部分分為四章,其中第一章、第二章是本文的基礎(chǔ)部分,第三章、第四章是本文的重點(diǎn)討論部分。第一章主要是對(duì)生態(tài)補(bǔ)償?shù)慕缍�。通過(guò)分析梳理當(dāng)前學(xué)界對(duì)生態(tài)補(bǔ)償概念的研究成果,界定了本文所討論的生態(tài)補(bǔ)償?shù)母拍?同時(shí)對(duì)生態(tài)補(bǔ)償進(jìn)行了分類,并對(duì)生態(tài)補(bǔ)償?shù)脑瓌t進(jìn)行了概述。第二章主要對(duì)生態(tài)補(bǔ)償‘的相關(guān)基礎(chǔ)理論進(jìn)行概述,主要從外部性原理、環(huán)境資源價(jià)值理論、可持續(xù)發(fā)展理論三個(gè)方面闡述生態(tài)補(bǔ)償?shù)恼?dāng)性；第三章是探討生態(tài)補(bǔ)償?shù)难a(bǔ)償標(biāo)準(zhǔn)與方式問(wèn)題,主要分析了我國(guó)生態(tài)補(bǔ)償標(biāo)準(zhǔn)的立法現(xiàn)狀和存在的問(wèn)題,并提出了完善建議；第四章主要討論生態(tài)補(bǔ)償?shù)某绦騿?wèn)題,主要是從生態(tài)補(bǔ)償程序的當(dāng)事人、程序的啟動(dòng)、協(xié)商程序、決定程序、救濟(jì)制度幾個(gè)方面展開討論。
[Abstract]:Ecological compensation is a solution that some countries and regions have tried to solve the problems of resource depletion and ecological destruction in the process of economic and social development since the 1950s. As an important means of ecological maintenance and construction, ecological compensation plays an active and important role in balancing and coordinating the tense relationship between economic and social development and ecological protection. Scholars in different disciplines have studied ecological compensation from different angles. Ecological compensation has become a hot topic in the fields of ecology, environmental economics, environmental management and sustainable development. At present, the ecological environment problem in our country is very serious, ecological compensation as a means of ecological maintenance and construction has been paid more and more attention. However, the basic law of ecological compensation has not been formulated in China, and ecological compensation rules are scattered in a large number of separate legal documents on environmental and resource protection, especially in local legislative documents. The lag of the legal system of ecological compensation has brought serious influence to the practice of ecological compensation in our country. Based on this, this paper intends to do a study on the relevant issues in the ecological compensation law from the perspective of law, in order to benefit the construction of the legal system of ecological compensation in China. In structure, this paper is composed of introduction and main part. The introduction part mainly introduces the research significance, research methods and contents of this paper, and briefly comments on the domestic and foreign literature. The main part is divided into four chapters, the first chapter, the second chapter is the basic part, the third chapter, the fourth chapter is the key part of this paper. The first chapter is the definition of ecological compensation. By analyzing and combing the current research results of the concept of ecological compensation in academic circles, this paper defines the concept of ecological compensation discussed in this paper, at the same time, classifies the concept of ecological compensation, and summarizes the principles of ecological compensation. The second chapter mainly summarizes the basic theory of ecological compensation, mainly from the externality principle, environmental resources value theory, sustainable development theory of three aspects of the legitimacy of ecological compensation; The third chapter discusses the compensation standard and method of ecological compensation, mainly analyzes the legislation status and existing problems of ecological compensation standard in China, and puts forward some suggestions. The fourth chapter mainly discusses the procedure of ecological compensation, mainly from the parties of the ecological compensation procedure, the start of the procedure, the negotiation procedure, the decision procedure, and the relief system.
