論農(nóng)村宅基地使用權(quán)的流轉(zhuǎn)
[Abstract]:Since the promulgation of the Land Management Law of the people's Republic of China, the legislation of our country has been adhering to the protection function of the rural homestead, taking the right to use the homestead as the living security of the peasants and prohibiting its circulation. The third Plenary session of the 18th CPC Central Committee adopted the "decision of the CPC Central Committee on comprehensively deepening the Reform", which refers to the relevant opinions on the reform of rural homestead. Thus in the civil and legal circles triggered on the transfer of rural homestead use hot debate. Starting from the basic theory of rural homestead, combined with the current practice of some pilot projects in China in the transfer of homestead, through summing up, the author proposes to allow the circulation of rural homestead right to use in a restricted way. And how to regulate the specific ideas. The article is divided into the following parts: the first part: summarizes the basic concepts of homestead use right, and analyzes the ownership and ownership of rural homestead in different historical periods from before and after the founding of the people's Republic of China. The second part analyzes the current transfer of homestead use right, mortgage, inheritance legislation and the difficulties encountered in practice. The third part: four pilot projects in Tianjin, Chongqing, Chengdu and Guangdong. The fourth part analyzes the respective reasons of the theory of "forbidden circulation", "restricted circulation" and "free circulation" of rural homestead, and puts forward the limited permission to transfer the right to use rural homestead. The fifth part: analyze the reason why the use right of rural homestead is allowed to be transferred in a limited way. Specifically includes two aspects: first, by combining the reform opinions of the 18th plenary session, discusses the necessity of the transfer of the right to use the rural homestead; second, in-depth analysis of why to attach restrictions on the circulation. The sixth part: how to regulate the circulation of rural homestead use right. This is the core part of this paper, mainly discusses the rural homestead transfer of the premise of regulation and specific ways of circulation. In the aspect of premise regulation, the principle of "one house and one house" is redefined, the right of ownership is clearly defined, the registration takes effect, the right to use the free homestead is prohibited from circulation, and the transfer, mortgage, inheritance and gift of the right to use the homestead are discussed concretely in the way of circulation.
