【摘要】：我國(guó)憲法第四十六條規(guī)定：中華人民共和國(guó)公民有受教育的權(quán)利和義務(wù)。國(guó)家培養(yǎng)青年、少年、兒童在品德、智力、體質(zhì)等方面全面發(fā)展。此項(xiàng)基本權(quán)利包括平等接受教育權(quán)、接受全面教育權(quán)等。因此，受教育權(quán)作為公民的一項(xiàng)基本權(quán)利，，是實(shí)質(zhì)平等價(jià)值的憲法體現(xiàn)。而運(yùn)動(dòng)員作為社會(huì)上存在的一個(gè)特殊群體，他們的主要時(shí)間都用于進(jìn)行體育訓(xùn)練和比賽，自運(yùn)動(dòng)生涯一開始，他們受教育的權(quán)利就受到了不同程度的侵害。學(xué)前教育的缺失、義務(wù)教育的片面、中等教育的尷尬、高等教育的不公平。針對(duì)其因受教育權(quán)受到損害而產(chǎn)生的各種不利后果，從主客觀方面分析運(yùn)動(dòng)員受教育權(quán)保障缺失產(chǎn)生的原因，以期通過健全立法、提高運(yùn)動(dòng)員權(quán)利意識(shí)、改革教學(xué)方法、確保教育投入、加強(qiáng)各部門監(jiān)督、完善法律救濟(jì)途徑等方式和手段來保障運(yùn)動(dòng)員受教育權(quán)的充分實(shí)現(xiàn)。
[Abstract]:Article 46 of our Constitution stipulates that citizens of the people's Republic of China have the right and duty to receive education. The state trains the youth, the child in the moral character, the intelligence, the physique and so on aspect comprehensive development. This basic right includes equal access to education and the right to comprehensive education. Therefore, the right to education, as a basic right of citizens, is the constitutional embodiment of substantive equal value. Athletes as a special group in society, their main time spent on sports training and competition, since the beginning of their sports career, their right to education has been violated to varying degrees. The absence of preschool education, the unilateral nature of compulsory education, the embarrassment of secondary education and the unfairness of higher education. In view of the various adverse consequences caused by the damage to the right to education, this paper analyzes the reasons for the lack of guarantee of athletes' right to education from subjective and objective aspects, in order to improve the awareness of athletes' rights and reform their teaching methods through sound legislation. In order to ensure the full realization of athletes' right to receive education, the ways and means of ensuring educational input, strengthening supervision of various departments and perfecting the ways of legal relief are ensured.
