我國現(xiàn)行政務督查制度研究

【摘要】:執(zhí)行力是政府的生命力所在,同時也是一個政黨生存發(fā)展的基礎。我國現(xiàn)在處于社會經(jīng)濟高速發(fā)展的階段,各項事業(yè)的開展都需要黨委和政府工作的支持。于是,黨委和政府工作的執(zhí)行力的高低,就成為了我國現(xiàn)階段的快速發(fā)展能否持續(xù)的關鍵。針對這一情況,黨中央和國務院分別發(fā)文,在黨委和政府內(nèi)部建立了政務督查制度。督查部門通過對黨委以及政府工作的督促和檢查,有效的促進二者工作的開展,最終落實為對社會經(jīng)濟的促進。在這樣的社會大背景下,本文論述的主體——政務督查制度,具有了研究的現(xiàn)實性和必要性。 本文的行文邏輯如下。在第一章中,本文從詞源、古代督查制度、制度的權力淵源以及現(xiàn)實運行情況四個方面,對政務督查進行一個全方位的梳理,最終得出該制度的基本概念。在第二章中,筆者將結合對相關文獻資料的閱讀和實地的調研研究,對政務督查制度在運行中存在的缺陷和問題予以總結概括,并分析問題的成因和影響。而之后的第三章是對存在問題提出完善的方法和可行的建議。 本文關注的重點問題如下。一、政務督查制度目前尚無具體法律對其進行規(guī)范和支持,甚至也無國務院相關條例。這就造成了該制度無法可依的現(xiàn)狀,影響督查工作的開展。二、督查工作得出的結果,并沒有得到合理的利用。這是因為參與督查工作的人員編制少、領導重視程度不足以及缺少工作上的權威性等原因。這就造成“督而不查”甚至是“查而不落實”的工作狀態(tài)。針對以上兩個問題,分別建議如下。一、將政務督查制度納入《公務員法》體系,用該法的成熟框架和具體規(guī)定,對督查制度進行規(guī)范。二、建立多部門、多職能合并的督查局,方面加強督查工作的組織基礎,另一方面提高督查工作在被督查部門中的權威地位,從而最終強化督查結果的運用。以上就是本文的行文邏輯和所關注的重點問題。
[Abstract]:Executive power is the vitality of the government, but also the basis for the survival and development of a political party. Our country is now in the stage of high-speed development of social economy, and the development of all undertakings needs the support of the Party committee and the government. Therefore, the execution ability of the Party committee and government has become the key to the sustainable development of our country at the present stage. In response to this situation, the Party Central Committee and the State Council issued separate papers and established the administrative supervision system within the party committee and the government. Supervision department through the supervision and inspection of the party committee and government work, effectively promote the development of the two work, and ultimately to promote the social economy. In such a social background, the subject discussed in this paper, the administrative supervision system, has the reality and necessity of research. The logic of this paper is as follows. In the first chapter, this article from the etymology, ancient supervision system, the power of the system as well as the actual operation of four aspects, a comprehensive combing of the administrative supervision, finally came to the basic concept of the system. In the second chapter, the author will summarize the shortcomings and problems in the operation of the administrative supervision system, and analyze the causes and effects of the problems. And the third chapter is to put forward the perfect method and feasible suggestion to the existing problem. The focus of this paper is as follows. First, there are no specific laws to regulate and support the administrative supervision system, or even the relevant regulations of the State Council. This resulted in the system can not be based on the status quo, affecting the work of supervision. Second, the results of supervision and inspection work, and has not been reasonable use. This is due to the small number of personnel involved in supervision, the lack of leadership attention and lack of authority. This results in a state of work in which "inspection without investigation" or even "investigation without implementation". In view of the above two problems, respectively, the recommendations are as follows. First, bring the administrative supervision system into the system of the Civil servant Law, and standardize the supervision system with the mature framework and specific provisions of the Law. Second, the establishment of multi-department, multi-function combined supervision and inspection bureau, in order to strengthen the organizational basis of supervision work, on the other hand, to enhance the authority position of supervision work in the supervised department, so as to strengthen the application of supervision results. The above is the logic of the text and the focus of attention.
