【摘要】：古語曰“民以食為天”,自古以來食品安全問題不僅僅與國民的身體健康休戚相關(guān),也直接影響到社會的和諧穩(wěn)定以及國家民族的健康發(fā)展。近幾年,濟(jì)源雙匯添加“瘦肉精”的豬肉、上海盛祿企業(yè)制作“染色饅頭”、天津等地加工“地溝油”、味千(中國)控股有限企業(yè)使用“豬骨湯精”等有關(guān)食品安全的駭人聽聞的事故頻頻發(fā)生,政府等權(quán)力機(jī)關(guān)予以高度重視,同時各界學(xué)者對此進(jìn)行深入研究。食品生產(chǎn)企業(yè)是確保食品安全、擔(dān)負(fù)社會責(zé)任的首要主體,本文通過文獻(xiàn)參考法、規(guī)范性分析法、實證分析法以及比較分析法,將有關(guān)食品生產(chǎn)企業(yè)應(yīng)承擔(dān)的社會責(zé)任作為基石,積極尋找我國食品生產(chǎn)企業(yè)全面落實食品安全社會責(zé)任的有效方式,為確保食品安全、保護(hù)消費者合法權(quán)益探索有效途徑。本文核心大致為以下三部分:第一部分,本部分解析了企業(yè)食品安全社會責(zé)任的概念,并界定本文的研究以食品生產(chǎn)企業(yè)為對象,其社會責(zé)任的特性包括:以確保食品安全為關(guān)鍵安全、企業(yè)是負(fù)擔(dān)食品安全社會責(zé)任的首要責(zé)任方、內(nèi)涵外延具有變動性動性。進(jìn)而明顯可見企業(yè)承擔(dān)食品安全社會責(zé)任的必要性包括:保障消費者合法權(quán)益、提高食品生產(chǎn)企業(yè)競爭力、維護(hù)社會秩序穩(wěn)定、促進(jìn)食品安全體系的建設(shè)和完善。第二部分,論述了目前食品生產(chǎn)企業(yè)落實食品安全社會責(zé)任的情況,分析我國目前落實企業(yè)食品安全社會責(zé)任所面臨的的困境,包括企業(yè)內(nèi)低效實施HACCP體系、食品行業(yè)自律機(jī)制不完善、企業(yè)社會責(zé)任信息披露報告不全面、企業(yè)食品安全信用檔案制度不完善。第三部分,探討了如何完善我國企業(yè)食品安全社會責(zé)任的法律問題。首先,從健全企業(yè)內(nèi)部食品安全社會責(zé)任落實機(jī)制的視角,完善HACCP體系在企業(yè)內(nèi)部的適用;其次,強(qiáng)化食品行業(yè)自律能力;再次,通過外部審計強(qiáng)化企業(yè)社會責(zé)任信息披露報告;最后,細(xì)化食品安全信用檔案制度使其趨于完備。
[Abstract]:As the ancient saying goes, "the people take food as the sky". Since ancient times, the problem of food safety has not only been closely related to the health of the people, but also directly affected the harmony and stability of the society and the healthy development of the nation. In recent years, Jiyuan Shuanghui added "lean meat essence" pork, Shanghai Shenglu enterprise made "dyed steamed bread", Tianjin and other places processed "gutter oil". The appalling accidents related to food safety such as "pig bone soup essence" are frequently used in Weiqian (China) holding limited enterprises. The government and other authorities attach great importance to them, and scholars from all walks of life have made a thorough study on them. Food production enterprises are the main body to ensure food safety and shoulder social responsibility. This paper adopts literature reference method, normative analysis method, empirical analysis method and comparative analysis method. Taking the social responsibility of the relevant food production enterprises as the foundation stone, this paper actively seeks the effective way for the food production enterprises to fully implement the social responsibility for food safety in order to ensure food safety and protect the legitimate rights and interests of consumers. The core of this paper is the following three parts: the first part, this part analyzes the concept of corporate food safety social responsibility, and defines the study of food production enterprises as the object, The characteristics of its social responsibility include: to ensure food safety as the key safety, the enterprise is the primary responsibility party to bear the social responsibility for food safety, and the connotation and denotation is variable. It is obvious that it is necessary for enterprises to undertake social responsibility for food safety, including: to protect the legitimate rights and interests of consumers, to improve the competitiveness of food production enterprises, to maintain social order and stability, to promote the construction and improvement of food safety system. The second part discusses the current situation of food production enterprises to implement food safety social responsibility, analyzes the current implementation of corporate food safety social responsibility in China facing the plight, including the inefficient implementation of the HACCP system within the enterprise. Food industry self-discipline mechanism is not perfect, corporate social responsibility information disclosure report is not comprehensive, enterprise food safety credit file system is not perfect. The third part discusses how to perfect the social responsibility of food safety in Chinese enterprises. First of all, from the perspective of perfecting the implementation mechanism of food safety social responsibility in enterprises, perfecting the application of HACCP system in enterprises, secondly, strengthening the self-discipline ability of food industry; Thirdly, strengthen the corporate social responsibility information disclosure report through external audit; finally, refine the food safety credit file system to make it more complete.
