【摘要】：行政檢查是最常見的一種行政程序,但長期以來并沒有引起人們的關注。我國立法中行政檢查的條文通常是包含在行政執(zhí)法檢查中加以概括規(guī)定的,學者對行政檢查的研究也相當不充分。而行政檢查作為一種行政權力運用的過程,直接影響著行政相對人的生產(chǎn)生活,存在著權力被濫用、損害行政相對人權利的風險,這些應當引起社會與學界對其進行關注與研究。隨著我國行政法體系的不斷完善和立法機關對行政檢查程序意義的深入認識,將行政檢查程序納入法律規(guī)制的軌道,成為建設依法行政和社會主義法治國家的必然要求。 本文主要采用案例分析和對比分析的方法,通過交通行政檢查等方面的案例說明行政檢查在實踐中存在的問題,從而引出對行政檢查進行立法規(guī)制的必要性和緊迫性；同時,通過對行政檢查制度比較完善的德國、日本等大陸法系國家的行政檢查制度進行對比分析,吸取其中有益的經(jīng)驗并以此作為完善我國行政檢查制度的經(jīng)驗加以借鑒。通過本文的寫作,希望能在對我國行政檢查的當前研究狀況、立法現(xiàn)狀和實踐情況有較為全面了解的基礎上,有針對性的提出完善我國行政檢查立法的幾點建議。從結構上看,本文共分為四章內(nèi)容： 第一章介紹行政檢查的基本理論,包括行政檢查的定義、名稱規(guī)范、行政檢查的性質(zhì)探討、行政檢查的法律特征以及行政檢查與相鄰概念的區(qū)別。 第二章重點介紹我國行政檢查的研究、立法和實踐現(xiàn)狀,并在此基礎上分析我國行政檢查在立法和實踐方面存在的問題。 第三章對境外的行政檢查制度進行對比分析,包括德國、日本和我國臺灣地區(qū)具有代表性的大陸法系國家或地區(qū)。通過對其各自行政檢查制度的介紹和評析,可以看到其中的特點及優(yōu)劣之處。 第四章在前述分析的基礎上,結合我國行政檢查的實踐,從五個方面對我國行政檢查制度的完善提出自己的建議。具體內(nèi)容主要包括：行政檢查的基本原則、行政檢查的適用條件、行政檢查的程序、行政檢查主體的職權與責任以及行政檢查的救濟五個方面。
[Abstract]:Administrative inspection is the most common administrative procedure, but it has not attracted people's attention for a long time. The provisions of administrative inspection in the legislation of our country are usually included in the general provisions of administrative law enforcement inspection, and the scholars' research on administrative inspection is also quite inadequate. As a process of the application of administrative power, administrative inspection has a direct impact on the production and life of the administrative counterpart, and there is the risk that the power is abused and the rights of the administrative counterpart are damaged. These should arouse the society and the academic circles to carry on the concern and the research to it. With the continuous improvement of the administrative law system and the legislative organs' understanding of the significance of the administrative inspection procedure, bringing the administrative inspection procedure into the track of legal regulation has become an inevitable requirement for the construction of a country governed by law and socialist rule of law. This article mainly uses the case analysis and the contrast analysis method, through the traffic administrative inspection and other aspects of the case to explain the administrative inspection in practice problems, thus leading to the necessity and urgency of the legislative regulation of administrative inspection; At the same time, through the comparative analysis of the administrative inspection system of Germany, Japan and other civil law countries, we draw on the beneficial experience and use it as a reference to perfect the administrative inspection system of our country. Through the writing of this paper, it is hoped that on the basis of a comprehensive understanding of the current research situation, legislation and practice of administrative inspection in our country, some suggestions for perfecting the legislation of administrative inspection in China can be put forward. From the structural point of view, this paper is divided into four chapters: the first chapter introduces the basic theory of administrative inspection, including the definition of administrative inspection, standard name, the nature of administrative inspection, The legal characteristics of administrative inspection and the difference between administrative inspection and adjacent concepts. The second chapter focuses on the research, legislation and practice of administrative inspection in China, and on this basis analyzes the problems in legislation and practice of administrative inspection in China. The third chapter makes a comparative analysis of the overseas administrative inspection system, including Germany, Japan and Taiwan, the representative civil law countries or regions. Through the introduction and evaluation of their respective administrative inspection systems, we can see their characteristics and advantages and disadvantages. On the basis of the above analysis and the practice of administrative inspection in our country, the fourth chapter puts forward some suggestions on the perfection of administrative inspection system in China from five aspects. The specific contents include: the basic principles of administrative inspection, the applicable conditions of administrative inspection, the procedure of administrative inspection, the authority and responsibility of the subject of administrative inspection and the relief of administrative inspection.
