【摘要】：文章通過還原土地改革時期以來不同階段典型的法律、政策與法規(guī),詳細(xì)梳理我國農(nóng)村土地政策的演進(jìn)歷程,揭示政策變遷過程中深層次的規(guī)律。研究結(jié)果表明,政策演進(jìn)過程中實質(zhì)是農(nóng)民土地權(quán)益交叉實現(xiàn)和不斷增強(qiáng)的過程。在更大程度上賦予農(nóng)民更清晰、更確定的土地權(quán)能是我國未來農(nóng)村土地制度改革的方向,因此,當(dāng)前在堅持土地承包責(zé)任制度的基礎(chǔ)上,可嘗試構(gòu)建以"農(nóng)民家庭"為主體的土地產(chǎn)權(quán)制度,以期最大限度保障農(nóng)民土地權(quán)益。
[Abstract]:By restoring the typical laws, policies and regulations in different stages since the period of land reform, this paper makes a detailed analysis of the evolution of rural land policies in China, and reveals the deep-seated laws in the process of policy changes. The results show that the essence of the policy evolution is the process of realizing and increasing the farmers' land rights and interests. To a greater extent, giving farmers a clearer and more definite land power is the direction of the future rural land system reform in China. Therefore, on the basis of adhering to the system of land contracting responsibility, We can try to construct the land property right system with "peasant family" as the main body, in order to protect the peasants' land rights and interests to the maximum extent.
