【摘要】：正現(xiàn)行《土地管理法》自1999年實施以來,對耕地保護、合理用地、理順土地管理程序、促進社會經(jīng)濟持續(xù)發(fā)展起到了重要作用,但由于立法的局限性,很難預(yù)見各類土地隱性違法行為,土地管理工作遇到了很多新問題。土地隱性違法行為的主要表現(xiàn)形式土地隱性違法行為介于合法與非法之間,有的在法律條款中無明確規(guī)定,有的雖有規(guī)定但無法律責(zé)任。結(jié)合對湖北遠安縣的調(diào)查,土地隱性違法行為主要有六種表現(xiàn)形式。以租代征,租用集體土地用于非農(nóng)業(yè)建設(shè)。
[Abstract]:Since the implementation of the current Land Management Law in 1999, it has played an important role in the protection of cultivated land, the rational use of land, the rationalization of land management procedures and the promotion of sustainable social and economic development, but due to the limitations of legislation, It is difficult to foresee all kinds of land recessive illegal behavior, land management has encountered many new problems. The main manifestation of land recessive illegal behavior is between legality and illegality, some of which are not clearly stipulated in the legal provisions, and some have no legal responsibility. According to the investigation of Yuan'an County, Hubei Province, there are six main forms of land recessive illegal behavior. Rent agent levy, lease collective land for non-agricultural construction.
