【摘要】：為了預(yù)防性侵犯罪案件的發(fā)生,美國(guó)、韓國(guó)等國(guó)家均設(shè)立了性犯罪者登記和公告制度,以此實(shí)現(xiàn)特殊預(yù)防和保護(hù)社區(qū)安全之目的。我國(guó)每年都有大量性犯罪案件發(fā)生,尤其是未成年人被性侵害案件的數(shù)量一直在高位徘徊,但我國(guó)目前尚未出臺(tái)相關(guān)措施進(jìn)行有效預(yù)防。鑒于性侵害未成年人犯罪人員的個(gè)人信息并不屬于隱私權(quán)保護(hù)范疇,從兒童最大利益原則出發(fā),可以適當(dāng)借鑒域外性犯罪者登記和公告制度,在我國(guó)構(gòu)建性侵害未成年人犯罪人員信息登記和有限公開機(jī)制,要求性侵害未成年人犯罪人員定期向司法機(jī)關(guān)登記,對(duì)該類人員中實(shí)施嚴(yán)重性犯罪行為或者具有較高再犯風(fēng)險(xiǎn)的犯罪人員,公開其個(gè)人信息,以此防范該類人員再犯和預(yù)防性侵害未成年人犯罪,保護(hù)公共安全和保障未成年人平安成長(zhǎng)。
[Abstract]:In order to prevent the occurrence of sexual assault cases, the United States, South Korea and other countries have set up a sexual offender registration and announcement system, so as to achieve the purpose of special prevention and protection of community safety. There are a large number of sexual crimes cases occurring in China every year, especially the number of minors who have been violated by sex has been hovering at a high level, but China has not yet issued relevant measures to effectively prevent. Considering that the personal information of a minor offender does not fall within the scope of protection of the right to privacy, and proceeding from the principle of the best interests of the child, the extraterritorial registration and announcement system for sex offenders may be used as an appropriate reference, In China, it is necessary to set up a mechanism for the registration and limited disclosure of information on persons who commit sexual assault against minors, and to require sexual offenders to register regularly with the judicial organs. In order to prevent such personnel from committing crimes against minors again and to prevent them from committing crimes against minors, the offender who commits a serious crime or has a higher risk of recidivism among such personnel shall be made public with his personal information, To protect public safety and ensure the safe growth of minors.
