【摘要】：在經(jīng)濟全球化的背景下，研究非物質(zhì)文化遺產(chǎn)為代表的“非遺”熱，體現(xiàn)著全球文化觀在廣度和深度中愈來愈成為一個浪潮，也被許多國家和地區(qū)以及國際組織納入共同課題。但與此同時，發(fā)展中國家中也出現(xiàn)了在傳統(tǒng)文化方面的暫時迷失狀況。各國政府強烈意識到經(jīng)濟發(fā)展與文化保護應(yīng)并駕齊驅(qū)，思考如何以理性、開放的心態(tài)創(chuàng)新地保護自己的傳統(tǒng)智慧以更好地拓展生存空間演變?yōu)槌墒斓奈幕泴嵙Ω偁幰庾R。但也要警惕長期立法實踐理論的研究不足和立法滯后有可能將造成非物質(zhì)文化遺產(chǎn)的被侵蝕改造乃至消失。 2011年《非物質(zhì)文化遺產(chǎn)法》的頒布,意味著我國以單獨立法模式確立了對非物質(zhì)文化遺產(chǎn)的法律保護。如何因地制宜地對分散于不同的省市及民間村落非物質(zhì)文化遺產(chǎn)進行保護，顯得緊急和迫切。近年來，梅州政府積極重視對非物質(zhì)文化遺產(chǎn)保護，但在工作層面也尚停留在節(jié)慶方式，完成申報等方面的工作，同時也存在著保護經(jīng)費不足，基層工作人員對非遺項目的挖掘、保護工作不上心，造成部分珍貴資料的人為丟失的情況。 本文將分析國內(nèi)外相關(guān)立法實例和經(jīng)驗，從宏觀到微觀，以小見大，深入基層,選取作者的家鄉(xiāng)——梅州為角度，分析梅州在非物質(zhì)文化遺產(chǎn)保護中遇到的困難、保護機制的缺陷和不足，思考結(jié)合現(xiàn)實做到切實可行地加強地方的立法保護。 本文期望通過田野調(diào)查等方式作出一些研究探討，探索一種在變革中有堅守，在借鑒中又有所突破和超越的綜合保護模式，以期待拋磚引玉。
[Abstract]:Under the background of economic globalization, the "non-legacy" heat represented by the study of intangible cultural heritage reflects that the global cultural concept is becoming a tide in its breadth and depth, and has also been brought into the common subject by many countries and regions and international organizations. But at the same time, there is a temporary loss of traditional culture in developing countries. Governments all over the world are keenly aware that economic development and cultural protection should go hand in hand, and consider how to protect their traditional wisdom with a rational and open mentality, so as to better expand the living space and evolve into a mature cultural soft power competitive consciousness. However, we should also guard against the lack of research on the theory of long-term legislative practice and the lag of legislation, which may lead to the erosion, transformation and even disappearance of intangible cultural heritage. The promulgation of the Intangible Cultural Heritage Law in 2011 means that our country has established the legal protection of the intangible cultural heritage by a separate legislative model. It is urgent and urgent to protect the intangible cultural heritage scattered in different provinces and cities and villages according to local conditions. In recent years, the Meizhou government has attached great importance to the protection of intangible cultural heritage, but at the work level, it has also remained in the work of the festival mode, the completion of the declaration and other aspects of work, while there is also insufficient funds for protection. Grass-roots staff excavation of non-legacy projects, protection work does not care, resulting in the loss of some valuable information. This article will analyze the domestic and foreign related legislation examples and the experience, from the macroscopic to the microscopic, through a small part to see the whole, goes deep into the grass roots, selects the author's hometown-Meizhou as the angle, analyzes the Meizhou in the intangible cultural heritage protection difficulty, The defects and shortcomings of the protection mechanism, combining with the reality to strengthen the local legislative protection. This paper looks forward to making some research and discussion by means of field investigation and exploring a comprehensive protection mode which is persevering in the reform and breakthrough and transcendence in the reference in order to look forward to throwing a brick and drawing on the jade.
