【摘要】：《食品安全法》規(guī)定了食品安全標(biāo)準(zhǔn)的制定應(yīng)科學(xué)合理，，在其2013年的修訂送審稿中，增加了標(biāo)準(zhǔn)制定公開透明的要求，這也要求食用農(nóng)產(chǎn)品質(zhì)量安全標(biāo)準(zhǔn)的制定要公開透明。聽證程序是聽取利害關(guān)系人意見特別是在做出不利于利害關(guān)系人的決定時給利害關(guān)系人發(fā)表意見的機(jī)會的程序。在食用農(nóng)產(chǎn)品質(zhì)量安全標(biāo)準(zhǔn)制定程序中加上聽證程序有利于實現(xiàn)標(biāo)準(zhǔn)制定的公開透明，科學(xué)合理。而且構(gòu)建我國食用農(nóng)產(chǎn)品質(zhì)量安全標(biāo)準(zhǔn)制定聽證程序有我國立法聽證制度及日本農(nóng)林產(chǎn)品標(biāo)準(zhǔn)制定聽證制度的借鑒和參考。筆者根據(jù)我國立法聽證制度、日本農(nóng)林產(chǎn)品標(biāo)準(zhǔn)制定聽證制度以及食用農(nóng)產(chǎn)品質(zhì)量安全標(biāo)準(zhǔn)制定本身具有的特點提出我國食用農(nóng)產(chǎn)品質(zhì)量安全標(biāo)準(zhǔn)制定聽證程序的構(gòu)建。對食用農(nóng)產(chǎn)品質(zhì)量安全標(biāo)準(zhǔn)的聽證事項、聽證機(jī)構(gòu)及聽證參加人、聽證會的啟動和準(zhǔn)備、聽證會的基本流程以及聽證筆錄和聽證報告的法律地位進(jìn)行論證。
[Abstract]:The Food Safety Law stipulates that the formulation of food safety standards should be scientific and reasonable. In its revised draft submitted for review in 2013, the requirements of openness and transparency in the formulation of standards for quality and safety of edible agricultural products are added, which also requires the formulation of standards for quality and safety of edible agricultural products to be open and transparent. The hearing procedure is the procedure for hearing the opinions of the interested parties, especially the opportunity for the interested parties to express their opinions when making decisions against the interested parties. Adding the hearing procedure to the quality and safety standard of edible agricultural products is beneficial to the realization of transparency and scientific and reasonable. Moreover, the construction of the quality and safety standard of edible agricultural products in China is based on the legislation hearing system of our country and the Japanese agricultural and forestry product standard establishment hearing system. According to the legislative hearing system of our country, the Japanese agricultural and forestry product standard establishment hearing system and the edible agricultural product quality safety standard formulation itself has the characteristic, the author puts forward the construction of our country edible agricultural product quality safety standard establishment hearing procedure. This paper demonstrates the hearing items of the quality and safety standard of edible agricultural products, the hearing organization and the participants, the initiation and preparation of the hearing, the basic process of the hearing, and the legal status of the hearing record and the hearing report.
