【摘要】：知情同意權是患者的一項基本權利,在此權利的貫徹過程中,經常會出現合法不合情與合情不合法兩種倫理與法律相沖突的情形,沖突的實質是醫(yī)患雙方利益的沖突。修改和完善與知情同意權相關的法律法規(guī),提升醫(yī)患雙方的道德水平,調適醫(yī)患雙方的利益是協調沖突的有效路徑。
[Abstract]:The right of informed consent is a basic right of patients. In the process of carrying out this right, two kinds of ethics and law conflict often occur. The essence of the conflict is the conflict of interests between doctors and patients. To modify and perfect the laws and regulations related to the right of informed consent, to improve the moral level of both doctors and patients, and to adjust the interests of both doctors and patients are the effective ways to coordinate the conflict.
