【摘要】：居住不僅是保障人類生存最基本的物質(zhì)條件，也是人類社會(huì)運(yùn)行和發(fā)展的基本保證。為了保障中低收入階層的居住權(quán)，我國發(fā)展以公租房為重點(diǎn)的住房保障制度。公租房租賃合同的法律性質(zhì)尚不明確，屬于無名合同，，其解除不僅關(guān)系到合同主體權(quán)益的保護(hù)，更關(guān)系到公租房的退出與循環(huán)出租，是公租房制度長效發(fā)展的關(guān)鍵。我國關(guān)于公租房租賃合同解除的法律規(guī)定主要集中于部門規(guī)章層面，法律層級(jí)較低且涉及內(nèi)容較少，但隨著公租房的不斷發(fā)展和繼續(xù)推廣，公租房租賃合同的解除勢(shì)必將得到社會(huì)和學(xué)界的普遍關(guān)注，其相關(guān)法律制度也將日臻完善。
[Abstract]:Residence is not only the most basic material condition to ensure human existence, but also the basic guarantee of human society's operation and development. In order to protect the residence right of middle and low income class, our country develops the housing security system which focuses on public rental housing. The legal nature of public rental contract is not clear, it belongs to nameless contract, its rescission is not only related to the protection of the rights and interests of the contract subject, but also related to the withdrawal and circulation of public rental housing, which is the key to the long-term development of the public rental housing system. The legal provisions on the termination of public rental housing contract in China mainly focus on the level of department rules and regulations, the legal level is lower and the content is less, but with the continuous development and continued promotion of public rental housing. The dissolution of public rental lease contract will be paid more and more attention by the society and academic circles, and the relevant legal system will be perfected day by day.
