合作行政背景下行政程序的變革與走向

【摘要】：合作行政背景下的行政程序是一種新的行政程序形態(tài)。協(xié)商民主、反思性法以及公私法融合為其提供了深厚的基礎(chǔ),此種行政程序可以在提升行政權(quán)力的民主正當(dāng)性、行政行為的可接受性以及社會的穩(wěn)定性中起到重要作用。具體而言,行政程序?qū)⒊韵碌姆较蜃兏?程序價值的兼容并包、主體結(jié)構(gòu)的伙伴化、程序風(fēng)格的交往理性化以及程序表達的論辯規(guī)則化�；诖�,未來在制定統(tǒng)一的中國行政程序法時,在制度選擇上需要強化對私人主體承擔(dān)行政任務(wù)的程序規(guī)范,重視重大行政決策中的協(xié)商式治理,注重合作式行政程序的設(shè)計與推廣以及程序參與主體在協(xié)商程序中的積極義務(wù)。
[Abstract]:The administrative procedure under the background of cooperative administration is a new form of administrative procedure. The fusion of deliberative democracy, reflective law and public and private law provides a deep foundation for it. This kind of administrative procedure can play an important role in promoting the democratic legitimacy of administrative power, the acceptability of administrative action and the stability of society. Specifically, the administrative procedure will change in the following directions: the inclusion of procedural value, the partnership of the subject structure, the rationalization of the communication style of the procedure and the regularization of the procedure expression. Based on this, in formulating the unified Chinese administrative procedure law in the future, we need to strengthen the procedural norms for the private subjects to undertake administrative tasks and attach importance to the consultative governance in major administrative decisions. Emphasis is placed on the design and promotion of cooperative administrative procedures and the positive obligations of procedure participants in the negotiation process.
