【摘要】：網(wǎng)絡求助是一種新興現(xiàn)象,其失范行為屢屢發(fā)生,諸如發(fā)布虛假信息、隱瞞關(guān)鍵信息、夸大困難程度和不幸遭遇、惡意造假炒作、善款使用存疑、流向不明等。網(wǎng)絡求助中的失范行為是技術(shù)條件的進步性、社會規(guī)范的滯后性與價值觀念的多元性之間錯位和異步的產(chǎn)物。由于正式制度的缺席和滯后,使網(wǎng)絡求助行為處于制度盲區(qū),加劇了這一非正式行為的失范風險。因此,必須通過制度建設和立法完善,將個人網(wǎng)絡求助行為納入法律規(guī)制范圍,構(gòu)建政府部門、網(wǎng)絡平臺、專業(yè)機構(gòu)和媒體大眾多方協(xié)同,事前、事中、事后全程監(jiān)管的精準治理體系,以制度力量防止有人借慈善之名行不義之事,促進網(wǎng)絡求助行為健康持續(xù)發(fā)展。
[Abstract]:Network help-seeking is a new phenomenon, and its abnormal behavior often occurs, such as issuing false information, concealing key information, exaggerating difficulty degree and unfortunate encounter, maliciously faking speculation, using the money with suspicion, and the direction is not clear, and so on. The abnormal behavior in network help is the result of the progress of technical conditions, the dislocation and asynchrony between the lag of social norms and the pluralism of values. Due to the absence and lag of the formal system, the network help-seeking behavior is in the blind area of the system, which exacerbates the risk of the informal behavior. Therefore, through the system construction and the legislation consummation, the personal network seeking help behavior must be brought into the legal regulation scope, constructs the government department, the network platform, the specialized organization and the media public multi-cooperation, beforehand, in the matter, The accurate governance system of the whole process of supervision after the event prevents people from doing injustice in the name of charity in order to promote the healthy and sustainable development of online help-seeking behavior.
