【摘要】：在現(xiàn)代社會救助中,社會救助的合理供給有賴于國家、社會等多元主體的共同作用。國家承擔法定救助責任,一般社會主體承擔道德性救助責任。社會救助法功能發(fā)揮與實現(xiàn)的關(guān)鍵在于國家及其救助責任的準確定位與實現(xiàn)。國家的救助責任包括給付責任與保障責任兩方面:國家給付責任的合理實現(xiàn)有賴于財政給付責任機制與財政墊付責任機制的完善;國家保障責任的合理實現(xiàn)亟需社會主體救助引導機制、國家社會救助責任監(jiān)督機制以及受助主體權(quán)責程序保障機制的合理建構(gòu)。
[Abstract]:In modern social assistance, the reasonable supply of social assistance depends on the joint action of the state, society and other pluralistic subjects. The state shall bear the legal responsibility of relief, and the general social subject shall bear the responsibility of moral relief. The key to play and realize the function of social assistance law lies in the accurate orientation and realization of the state and its relief responsibility. The relief responsibility of the state includes two aspects: the reasonable realization of the national responsibility for payment depends on the perfection of the mechanism of the responsibility of the financial supply and the mechanism of the responsibility of the advance payment; The reasonable realization of the national security responsibility needs the reasonable construction of the guiding mechanism of the social main body, the supervision mechanism of the national social assistance responsibility and the guarantee mechanism of the aided subject's power and responsibility procedure.
