【摘要】：我國現(xiàn)有的對政府購買公共服務(wù)制度發(fā)揮規(guī)制作用的文件效力層級多樣,包括法律、行政法規(guī)、部委規(guī)章、地方政府規(guī)章及規(guī)范性文件,其中以效力層級較低的規(guī)范性文件為主。這些文件中對政府購買公共服務(wù)的范圍所作規(guī)定不盡相同,且不同文件之間銜接性不強(qiáng),內(nèi)容龐雜而不成體系,面臨著不少問題。本文以現(xiàn)有文件為依據(jù),進(jìn)行梳理,聚焦政府購買公共服務(wù)范圍的概念,以面向未來的視角分析現(xiàn)有文件的內(nèi)容,理出應(yīng)當(dāng)解決的問題。就規(guī)制方式而言,首先需統(tǒng)一概念、明確標(biāo)準(zhǔn),其次需選擇較為科學(xué)的規(guī)制路徑。就規(guī)制內(nèi)容而言,一方面需明確界定原則、界定標(biāo)準(zhǔn),科學(xué)確定我國政府購買公共服務(wù)的范圍,編制明確細(xì)致的政府購買公共服務(wù)目錄;另一方面需采取措施完善相關(guān)制度,如財政保障制度、社會組織扶持制度、公眾參與制度等。通過對政府購買公共服務(wù)的范圍進(jìn)行研究,以期使本文對我國政府購買公共服務(wù)體系的發(fā)展有所裨益。
[Abstract]:There are a variety of levels of effectiveness of the existing regulations on government purchase of public services, including laws, administrative regulations, ministerial regulations, local government regulations and normative documents. Among them, the normative documents with lower level of validity are the main ones. In these documents, the scope of government purchase of public services is not the same, and the different documents are not well connected, and the contents of these documents are complex and not systematic, and they are faced with many problems. Based on the existing documents, this paper focuses on the concept of the scope of government purchase of public services, analyzes the contents of existing documents from a future-oriented perspective, and points out the problems that should be solved. As far as the regulation mode is concerned, it is necessary to unify the concept, define the standard, and then choose a more scientific regulation path. As far as the content of regulation is concerned, on the one hand, it is necessary to clearly define the principles and standards, scientifically determine the scope of government purchase of public services, and compile a clear and detailed catalogue of government purchase of public services. On the other hand, measures should be taken to perfect the relevant systems, such as financial security system, social organization support system, public participation system and so on. Through the research on the scope of government purchasing public service, this paper will benefit the development of our government purchasing public service system.
