【摘要】：我國(guó)正考慮社會(huì)信用立法,考慮到我國(guó)實(shí)際,中觀層面的兼具經(jīng)濟(jì)和社會(huì)屬性的社會(huì)信用入法成為必須。圍繞信用信息的記錄采集、歸集共享、公開、應(yīng)用、保護(hù)這條主線設(shè)計(jì)社會(huì)信用立法框架和內(nèi)容非常必要。這其中特別需要通過異議處理和信用修復(fù)等機(jī)制加強(qiáng)信息主體的權(quán)益保護(hù);通過政府帶頭示范應(yīng)用、鼓勵(lì)引導(dǎo)社會(huì)應(yīng)用和做好動(dòng)態(tài)聯(lián)動(dòng),構(gòu)建起合理的信用獎(jiǎng)懲機(jī)制。
[Abstract]:China is considering the legislation of social credit, considering the reality of our country, the social credit entry law with both economic and social attributes is necessary. It is necessary to design the legislative framework and content of social credit around the collection, sharing, publicity, application and protection of credit information. In particular, it is necessary to strengthen the protection of the rights and interests of the information subject through the mechanism of dissent treatment and credit repair, and to encourage the social application and the dynamic linkage to construct a reasonable credit reward and punishment mechanism through the government taking the lead to demonstrate the application.
