中學(xué)畢業(yè)班教師休息權(quán)保障研究

【摘要】:近年來(lái),我國(guó)中學(xué)畢業(yè)班教師休息權(quán)保障存在的問(wèn)題日益凸顯。由于教師的特殊的職業(yè)身份,他們長(zhǎng)期從事著長(zhǎng)時(shí)間、高負(fù)荷的工作,教師們的健康每況愈下。尤其是畢業(yè)班教師頂著升學(xué)壓力長(zhǎng)時(shí)間工作,使得他們疲憊不堪,身心疾病增加。這些不良狀況已經(jīng)影響了教師創(chuàng)造力和自身潛能的發(fā)揮,進(jìn)而降低了教育教學(xué)效率。長(zhǎng)此以往形成惡性循環(huán),不管是對(duì)教師權(quán)利的保障還是對(duì)教育教學(xué)活動(dòng)的發(fā)展都是有百害而無(wú)一利的。因此,討論中學(xué)畢業(yè)班教師休息權(quán)問(wèn)題是十分必要也是非常緊迫的。 本研究主要包括五個(gè)章節(jié)。第一章是引言,主要包括問(wèn)題的提出、研究的意義、研究目的、概念界定和文獻(xiàn)綜述以及研究方法。第二章主要對(duì)所用的理論基礎(chǔ)進(jìn)行了闡述,,主要包括人本原理、教師權(quán)利理論和權(quán)利保障理論三個(gè)理論,這些理論為研究提供了理論支撐。在第三章中,采用了問(wèn)卷調(diào)查的方法和訪(fǎng)談法,從教師工作時(shí)間、休息時(shí)間、占用節(jié)假日?qǐng)?bào)酬情況等多個(gè)維度進(jìn)行。通過(guò)調(diào)查總結(jié)了中學(xué)畢業(yè)班教師休息權(quán)保障的現(xiàn)狀,主要表現(xiàn)在工作時(shí)間過(guò)長(zhǎng)、節(jié)假日被占用、閑暇不夠充分和休息時(shí)被打擾四個(gè)方面。第四章在梳理了與中學(xué)畢業(yè)班教師休息權(quán)相關(guān)主體的權(quán)利義務(wù)關(guān)系的同時(shí),分析了影響中學(xué)畢業(yè)班教師休息權(quán)保障的影響因素。我們主要從主體的角度,分析了教師方面、學(xué)校方面、家長(zhǎng)方面和社會(huì)方面四個(gè)因素;在此基礎(chǔ)上,論文的第五章針對(duì)影響因素提出了立法保障、執(zhí)法保障、監(jiān)督保障和其他保障四個(gè)方面的保障策略。其中,立法保障包括明確對(duì)中學(xué)教師的工作時(shí)間和工作量的具體規(guī)定和確保教師得到應(yīng)得的勞動(dòng)報(bào)酬與補(bǔ)償。執(zhí)法保障包括執(zhí)行《教師法》及其相他有關(guān)保障教師休息權(quán)的法律、法規(guī)活動(dòng)具體包括制定推行教育法規(guī)的行政措施、對(duì)有關(guān)主體守法情況進(jìn)行監(jiān)督,以及對(duì)違法行為采取制裁措施等。監(jiān)督保障包括加強(qiáng)和完善人大的監(jiān)督、強(qiáng)化法律監(jiān)督機(jī)關(guān)和相關(guān)行政監(jiān)察機(jī)關(guān)的職能、完善群眾監(jiān)督機(jī)制。其他保障主要包括教師自身、學(xué)校、家長(zhǎng)三個(gè)方面。
[Abstract]:In recent years, the problems existing in the protection of teachers' rest right in middle school graduating class have become increasingly prominent. Due to the special professional status of teachers, they have been engaged in long hours and heavy work for a long time, and their health is deteriorating. In particular, graduating teachers work long hours under the pressure of higher education, resulting in fatigue and increased mental and physical illness. These bad conditions have affected teachers' creativity and their potential, and thus reduced the efficiency of education and teaching. In the long run, a vicious circle is formed, whether it is the protection of teachers' rights or the development of educational and teaching activities. Therefore, it is necessary and urgent to discuss the right to rest of middle school graduating class teachers. This research mainly includes five chapters. The first chapter is the introduction, including the question, the significance of the research, the purpose of the research, the definition of the concept and literature review, as well as research methods. The second chapter mainly expounds the theoretical basis used, mainly includes three theories: humanism, teachers' rights theory and rights guarantee theory, which provide theoretical support for the research. In the third chapter, the method of questionnaire survey and interview are used, from the teachers' working time, rest time, occupation of holiday compensation and other dimensions. This paper summarizes the present situation of the protection of the teachers' rest right in the graduating class of middle school through investigation, which mainly shows in four aspects: the excessive working hours, the occupation of holidays, the insufficiency of leisure and the interruption of rest. The fourth chapter combs the relationship between the rights and obligations of the subjects concerned with the teachers' right to rest in the graduating class, and analyzes the factors that affect the protection of the teachers' right to rest in the graduating class. From the perspective of the main body, we analyze four factors: teachers, schools, parents and society. On this basis, the fifth chapter of the paper puts forward the legislative protection, law enforcement protection for the influencing factors. Safeguards and other safeguards in four aspects of the safeguards strategy. Among them, the legislative guarantee includes the specific stipulation of the working hours and workload of the middle school teachers and the guarantee of the teachers' due remuneration and compensation. The enforcement of the law includes the enforcement of the Teachers Law and its laws concerning the protection of teachers' right to rest. The specific activities of the laws and regulations include the formulation of administrative measures for the implementation of educational laws and regulations, and the supervision of the compliance of relevant subjects with the law. As well as the illegal conduct to take the sanction measure and so on. The supervision guarantee includes strengthening and perfecting the supervision of the people's Congress, strengthening the functions of the legal supervisory organs and the related administrative supervisory organs, and perfecting the supervision mechanism of the masses. Other guarantees include teachers themselves, schools and parents.
