【摘要】：正當(dāng)競(jìng)技行為具有激烈的對(duì)抗性和競(jìng)爭(zhēng)性,嚴(yán)格的規(guī)則性和公平性,良好的觀賞性和示范性以及刑事法律的正當(dāng)性,因而與體育暴力行為區(qū)分開來(lái)。在正當(dāng)化事由中,正當(dāng)競(jìng)技行為區(qū)別于被害人承諾、正當(dāng)業(yè)務(wù)行為等正當(dāng)化事由,而是獨(dú)立的一種正當(dāng)化事由類型。正當(dāng)競(jìng)技行為的正當(dāng)化根據(jù)在于法益的衡量,其與違法性理論息息相關(guān)。成立正當(dāng)競(jìng)技行為的條件必須是在主體上為參加競(jìng)技體育中的運(yùn)動(dòng)員,主觀上以比賽為目的,且發(fā)生在對(duì)抗性的競(jìng)技體育活動(dòng)中,而沒(méi)有超過(guò)必要的限度。
[Abstract]:Due to its fierce antagonism and competition, strict rules and fairness, good appreciation and demonstration, and the legitimacy of criminal law, it is distinguished from sports violence. In the cause of justification, the legitimate competitive behavior is different from the victim's commitment, the legitimate business behavior and other legitimate reasons, but an independent type of legitimate cause. The justification of proper competitive behavior lies in the measurement of legal interests, which is closely related to the theory of illegality. The condition of establishing proper competitive behavior must be that the main body is for the athletes participating in competitive sports, the subjective aim is to compete, and it must occur in the antagonistic competitive sports activities, without exceeding the necessary limit.
