【摘要】：2014年4月份起,公安部開展了全國公安機(jī)關(guān)依法使用武器警械專項(xiàng)訓(xùn)練活動(dòng),自此北京、上海、鄭州等國內(nèi)多個(gè)城市的一線民警紛紛開始持槍上街巡邏。同年新疆發(fā)生"5 · 22嚴(yán)重暴力恐怖襲擊事件",為打擊各種嚴(yán)重暴力犯罪活動(dòng),維護(hù)社會(huì)安定秩序,全國各地安保升級(jí),民警持槍巡邏已成常態(tài)。至此,警用槍支使用的規(guī)范化問題又成為民眾密切關(guān)注的話題。本文從分析我國立法現(xiàn)狀入手,提出警察槍支使用權(quán)存在著立法滯后、上位法與下位法之間,以及同位階規(guī)范之間銜接不緊密;立法規(guī)定的槍支使用原則單一化;使用槍支程序不完善的問題。繼而本文提出應(yīng)修改當(dāng)前的法律法規(guī)、提升設(shè)定警察槍支使用權(quán)規(guī)范的效力;借鑒國外及相關(guān)地區(qū)的經(jīng)驗(yàn),把生命威脅原則納入法律規(guī)定內(nèi),從而彌補(bǔ)《中華人民共和國人民警察使用警械和武器條例》在適用中的不足之處;最后,立法機(jī)關(guān)應(yīng)制定出系統(tǒng)化、清晰化和完善的警察使用槍支的法定程序,規(guī)范和指引警察合法合理地使用槍支。
[Abstract]:Since April 2014, the Ministry of Public Security has launched a nationwide special training campaign for public security organs to use weapons and equipment in accordance with the law. Since then, first-line police officers in Beijing, Shanghai, Zhengzhou and other cities have taken to the streets with guns to patrol. In the same year, "5 22 serious violent terrorist attacks" occurred in Xinjiang. In order to crack down on all kinds of serious violent criminal activities and maintain social stability and order, security in various parts of the country was upgraded, and police patrols with guns have become the norm. So far, the standardization of the use of police guns has become a topic of close concern to the public. Based on the analysis of the present situation of legislation in our country, this paper points out that there is a lag in legislation for the use of police guns, not close connection between the upper and lower laws and the same rank norms, and the simplification of the principles of the use of firearms as stipulated by the legislation. The problem of imperfect procedures for the use of firearms. Then this paper proposes that the current laws and regulations should be revised to enhance the effectiveness of establishing the police gun use right norms, and to draw lessons from the experience of foreign countries and related regions to incorporate the principle of life threat into the legal provisions. In order to make up for the deficiencies in the application of the regulations of the people's Republic of China on the use of Police equipment and weapons, the legislature should formulate systematic, clear and perfect legal procedures for the use of firearms by the police. Regulate and guide the police to use guns legally and reasonably.
